Information Circular 13 of 2007: Extension for Electronic Submission of 2006 Annual Financial Statements

The South African Financial Services Board extends the deadline to 31 March 2008 for the mandatory electronic submission of 2006 annual financial statements by pension funds and administrators. While small funds may submit unaudited reports per previous circulars, all entities must utilize the regulator's specified electronic filing guidelines. Non-compliance or deliberate delays will trigger financial penalties and further regulatory sanctions under the Pension Funds Act.

## INFORMATION CIRCULAR 13 OF 2007

### GENERAL EXTENSION FOR THE ELECTRONIC SUBMISSION OF THE 2006 ANNUAL FINANCIAL STATEMENTS IN TERMS OF SECTION 33 OF THE PENSION FUNDS ACT, 24 OF 1956 (“the Act”)

In terms of section 33(1) of the Act, extension is hereby granted for the submission of annual financial statements for the 2006 financial year-ends until **31 March 2008**. Funds are reminded of the contents of Information Circular 12 of 2007 whereby small funds would be allowed to submit unaudited financial statements for the 2006 annual year-ends.

Funds which remain in default or any party that contributes to unnecessary delay will be levied a penalty and/or subjected to any other regulatory intervention as per the Act.

The said annual financial statements referred to above, must be submitted electronically by the due date. Guidelines for the electronic submission of financial statements are available on the website, **www.fsb.co.za** under “retirement funds department/electronic submissions/financial statements”.
