Director of WA tiling business charged with making false statement

ASIC charged John William Muir, director of JW Tiling & Stone Pty Ltd, with authorizing a false deregistration declaration under section 1308(1) of the Corporations Act 2001. The allegation states Muir knowingly declared the company had no outstanding liabilities despite owing over $195,000 to a creditor. The matter is being prosecuted by the CDPP with a maximum penalty of five years imprisonment, and the case is currently adjourned to August 2026 after Muir entered a not guilty plea.

John William Muir of Western Australia has been charged with one count of authorising the making of a false statement in a document lodged with ASIC contrary to section 1308(1) of the Corporations Act 2001 .

Mr Muir appeared at the Perth Magistrate’s Court on 23 January 2026 for first mention. At the time of the alleged offence, Mr Muir was the director of JW Tiling & Stone Pty Ltd, a company which operated a wall and floor tiling business in the Perth Metropolitan Area.

Following an ASIC investigation, it is alleged that on 12 July 2024, Mr Muir authorised the lodgement of a form to deregister the company which contained a declaration that the company had no outstanding liabilities, knowing that declaration was false because the company owed over $195,000 to a creditor.

The matter was adjourned to 6 March 2026 for Mr Muir to obtain legal advice. Mr Muir was placed on bail with a personal undertaking of $5,000. This matter is being prosecuted by the Office of the Director of Public Prosecutions (Cth) (CDPP).

The maximum penalty for the alleged offence is five years imprisonment when heard summarily in the Magistrates Court.
