The Supervisor of Banks issued regulations governing the conduct of banking corporation clerks during police investigations or when warrants are issued. Clerks must comply with police requests to withhold information about warrants or investigations from customers, unless the police have seized original documents. If a customer initiates an inquiry, clerks may confirm the existence of an investigation but are prohibited from elaborating on its nature or substance.

POLICE INVESTIGATIONS
Introduction
If a warrant is issued for documents to be furnished to the police, or if a police investigation
is proceeding under law, the clerks of the banking corporation shall act as stated in this
regulation.
Disclosure to a customer
(a) If a representative of the police has requested from a clerk employed by the banking
corporation not to reveal to a customer that a warrant as aforesaid has been issued (if
the warrant does not include a specific prohibition on informing the customer) or that a
police investigation is proceeding, the clerk shall comply with the request not to supply
the customer at his initiative with the said information. This rule shall not apply if the
police have taken the customer’s original documents (in contrast with copies).
(b) If the customer has, at his own initiative, asked whether an investigation is being
conducted or a warrant has been issued, and the banking corporation has been asked
not to reveal that this is in fact the case, the clerk is entitled to reply that an
investigation is being conducted or a warrant has been issued, but shall not elaborate
on the nature or substance of the investigation.
(c) If a court order to furnish documents includes a specific ban on disclosing information
to the customer, it goes without saying that the clerk of the banking corporation shall
not disclose to the customer that he is being investigated, or that a warrant as aforesaid
has been issued.
