Caution Regarding Fair Lending Practices, Monitoring and Documentation

The Alabama State Banking Department issued a memorandum to state-chartered banks warning that fair lending noncompliance poses severe safety and soundness risks. Regulators require institutions to implement robust monitoring systems and maintain detailed documentation to justify any pricing disparities identified in Home Mortgage Disclosure Act data. Banks are advised to review loan officer incentives, ensure adequate data capture, and consult federal regulators or retain expert consultants if potential discrimination is detected.
