Instruction No. 2017-I-10 Amending Instruction No. 2015-I-02 Regarding the Nomination or Renewal Form for Executives of Insurance Sector Entities

PRUDENTIAL SUPERVISION AND RESOLUTION AUTHORITY

Instruction No. 2017-I-10 amending Instruction No. 2015-I-02 regarding the form for the nomination or renewal of executives of entities in the insurance sector

The Prudential Supervision and Resolution Authority, Having regard to the Insurance Code, particularly Article L. 322-2; Having regard to the Monetary and Financial Code, particularly Articles L. 612-23-1, R. 612-29-3 and R. 612-29-4; Having regard to the Mutual Code, particularly Articles L. 114-18 and L. 114-21; Having regard to the Social Security Code, particularly Article L. 931-7-2; Having regard to Instruction No. 2015-I-02 regarding the form for the nomination or renewal of executives of entities in the insurance sector; Having regard to the opinion of the Consultative Committee on Prudential Affairs dated June 1, 2017; DECIDES

Article 1: In Article 1 of the aforementioned Instruction No. 2015-I-02, the words "in paragraph II" are replaced by the words "in the second sentence of paragraph II".

Article 2: Article 2 of the aforementioned Instruction No. 2015-I-02 is replaced by the following provisions: "The companies subject to the provisions mentioned in Article 1 must declare to the Prudential Supervision and Resolution Authority any appointment or renewal of members of the management board, general directors, delegated general directors, the sole general director, the Chairman of the Board of Directors mentioned in Article L. 114-18 of the Mutual Code, and any other person called upon to exercise equivalent functions. The declaration mentioned in the preceding sentence is made using the form attached to this Instruction."

Article 3: The annex to the aforementioned Instruction No. 2015-I-02 is replaced by the annex to this Instruction.

Article 4: This Instruction enters into force upon its publication in the Official Register of the Prudential Supervision and Resolution Authority.
