Financial Market Authority Act (FMABG)

The Austrian Federal Government enacted the Financial Market Authority Act to establish an independent, instruction-free supervisory body headquartered in Vienna that oversees banking, insurance, securities, and pension funds. The legislation mandates a two-tier governance structure comprising an Executive Board and a Supervisory Board, while integrating the FMA’s statutory powers across dozens of national laws and EU regulations such as DORA and MiCA. Furthermore, the Act defines clear public liability frameworks for FMA personnel, establishes comprehensive financial planning and reporting obligations, and ensures coordinated supervision with the Oesterreichische Nationalbank and European authorities.
