Bulletin 2001-6: Standard Limits of Liability for Oregon Workers' Compensation Policies

The Oregon Insurance Division mandates an increase in standard employer liability limits for workers' compensation policies to $500,000 for both bodily injury by accident and disease. This regulatory change responds to the Oregon Supreme Court's ruling in Smothers v. Gresham Transfer, which exposed policyholders to potentially unlimited liability beyond the previous $100,000 cap. The new limits become effective January 1, 2002, for new and renewal policies, resulting in a 1.7 percent premium increase while allowing insurers to file justified deviations under open competition ratemaking laws.
