The European Banking Authority partially repeals EBA/GL/2017/15 on connected clients to eliminate redundancy with Commission Delegated Regulation (EU) 2024/1728. This decision deletes paragraphs 11 to 33, which correspond to Sections 4, 6, and 7 of the original guidelines, as the relevant regulatory technical standards are now directly specified in EU law. The partial repeal enters into force immediately and is reflected in the consolidated text of the guidelines.
Decision of the European Banking Authority EBA/DC/644 of 26 March 2026 concerning the partial deletion of EBA/GL/2017/15 on connected clients The Board of Supervisors Having regard to Regulation (EU) No 1093/2010 of the European Parliament and of the Council of 24 November 2010 establishing a European Supervisory Authority (European Banking Authority), amending Decision No 716/2009/EC and repealing Commission Decision 2009/78/EC1 , in particular Articles 16(2a) and 29(1), point (d) thereof, Having regard to Regulation (EU) No 575/2013 of the European Parliament and of the Council of 26 June 2013 on prudential requirements for credit institutions and amending Regulation (EU) No 648/20122 , in particular Article 4(4) thereof, Having regard to Commission Delegated Regulation (EU) 2024/1728 of 6 December 2023 supplementing Regulation (EU) No 575/2013 of the European Parliament and of the Council with regard to regulatory technical standards specifying in which circumstances the conditions for identifying groups of connected clients are met3 , in particular Articles 1, 2 and 3 thereof, Whereas: (1) Since the European Banking Authority (‘EBA’) guidelines, EBA/GL/2017/15 on connected clients (the ‘EBA guidelines on connected clients’) were issued, Commission Delegated Regulation (EU) 2024/1728 has been adopted which now regulates certain of the matters covered in the guidelines. In particular, the legislation specifies the circumstances in which the conditions for identifying groups of connected clients are met including the control relationship, the economic dependency and the combined control relationships and economic dependencies. (2) It is no longer necessary to maintain the areas targeted by Sections 4, 6 and 7 of the EBA guidelines on connected clients to ensure the common, uniform and consistent application of Union law and they should therefore be deleted.
