Oregon Insurance Division Bulletin INS 2012-1: Application of Senate Bill 2 to Gender Identity Issues

The Oregon Insurance Division issued Bulletin INS 2012-1 to require insurers to comply with the Oregon Equality Act by prohibiting discrimination based on gender identity in the transaction of insurance. The bulletin establishes six principles mandating that insurers cannot deny coverage or impose exclusions solely due to gender identity, must apply medical necessity standards equally, and must provide mandated sex-specific screenings regardless of a patient's perceived gender identity. Additionally, the Division interpreted existing mental health parity rules to require coverage for gender identity disorder treatment for all ages and expects all insurance forms to align with these nondiscrimination policies.
