Regulation to Amend Regulation 11-102 Respecting Passport System

The securities regulators amended Regulation 11-102 respecting the Passport System to modernize its electronic disclosure framework. The amendment replaces all instances of "SEDAR" with "SEDAR+" and updates the cross-reference to Regulation 13-103 in Section 3.3 and Appendix D. The regulation comes into force on June 9, 2023, with Saskatchewan permitting a delayed effective date upon filing.

REGULATION TO AMEND REGULATION 11-102 RESPECTING PASSPORT SYSTEM Securities Act (chapter V-1.1, s. 331.1, par. (1), (2) and (34))

  1. Section 1.1 of Regulation 11-102 respecting Passport System (chapter V-1.1, r. 1) is amended: (1) by striking out the definition of the expression “SEDAR”; (2) by inserting, after the definition of the expression “prospectus”, the following: ““SEDAR+” has the same meaning as in Regulation 13-103 respecting System for Electronic Data Analysis and Retrieval + (SEDAR+) (insert reference);”.
  2. Section 3.3 of the Regulation is amended by replacing “SEDAR”, wherever it appears, by “SEDAR+”.
  3. Appendix D of the Regulation is amended by replacing “SEDAR” by “SEDAR+” and “Regulation 13-101” by “Regulation 13-103”.
  4. Effective Date (1) This Regulation comes into force on 9 June 2023. (2) In Saskatchewan, despite paragraph (1), if this Regulation is filed with the Registrar of Regulations after 9 June 2023, this Regulation comes into force on the day on which it is filed with the Registrar of Regulations.
