Assistant Deputy Commissioner Kevin Glendening issued this memo to clarify the application of amended K.S.A. 9-1102, which permits banks to carry real estate acquired through DPC for up to 10 years with possible extensions. The department applies this 10-year holding period retroactively to existing ORE assets and allows rebooking of previously charged-off properties provided the combined book and nonbook holding time does not exceed 10 years. Banks must obtain current appraisals to support any rebooked amounts and secure annual approval for extensions beyond the initial decade.
