Oregon Division of Financial Regulation Bulletin 2017-1: Contraceptive Extended Dispensing Mandate Administration

The Oregon Division of Financial Regulation issued Bulletin 2017-1 to clarify insurer compliance with ORS 743A.066 regarding the mandatory 12-month contraceptive dispensing mandate. The agency adopted the proposed bulletin with amendments suggested by Planned Parenthood to explicitly define noncompliant activities, such as denying 12-month supply coverage or imposing inequitable pharmacy network tier restrictions. The division rejected arguments from Moda Health and Providence Health Plan, affirming that cost-sharing provisions must apply equally to all prescriptions and cannot be used to undermine the statutory requirement for extended dispensing.
