PRUDENTIAL CONTROL AND RESOLUTION AUTHORITY

Instruction No. 2021-I-20 on the information to be transmitted to the Prudential Control and Resolution Authority in the context of the acquisition or extension of participation in a financing company, an electronic money institution, or a payment institution

The Prudential Control and Resolution Authority, Having regard to the Monetary and Financial Code, particularly Articles L. 511-12-1, L. 522-10-1, L. 526-13, and R. 511-3-2; Having regard to the Decree of December 4, 2017, relating to the approval, modification of status, withdrawal of approval, and deregistration of financing companies, as well as the reporting obligations of certain financial institutions; Having regard to the Decree of October 29, 2009, on the prudential regulation of payment institutions; Having regard to the Decree of May 2, 2013, on the prudential regulation of electronic money institutions; Having regard to the opinion of the Prudential Affairs Consultative Committee of November 16, 2021, DECIDES

Article 1: Operations involving the acquisition or extension of participation in financing companies, electronic money institutions, or payment institutions, which are subject to the prior authorization of the Prudential Control and Resolution Authority, shall be notified to it by transmitting the form attached to this instruction.

Article 2: This instruction shall enter into force on the fifteenth day following the day of its publication in the official register of the Prudential Control and Resolution Authority.
