Subject: Letter from His Eminence the Chief Justice of Palestine

With reference to the above subject, please find attached a letter from His Eminence the Chief Justice of Palestine / President of the Sharia Judicial Council regarding permits to disburse funds belonging to minors from banks operating in the southern governorates. Please take the necessary legal measures to implement the requirements of the attached letter.

Peace, mercy, and blessings of God be upon you,

Subject: Permits to disburse funds belonging to minors from banks operating in the southern governorates.

We extend our best greetings. With regard to the above subject and in accordance with Paragraph (4) of Article (2) of Law No. 44 of 2022 concerning transactions involving the funds of minors, absentees, and those lacking legal capacity, and Articles 14, 16, 17, and 18 of Law No. 14 of 2005 concerning the establishment of the Administration and Development of Orphans' Funds and its amendments.

We kindly request that you instruct banks operating in the southern governorates, particularly Bank of Palestine and Palestinian Islamic Bank, as well as other banks, not to disburse any funds belonging to minors that have been received from any official or unofficial source, except after obtaining permission from the Sharia Judge and approval from the Supreme Sharia Court in Ramallah, in accordance with the law.

Subject: Inheritance restriction documents issued by Sharia courts in the southern governorates.

We extend our best greetings and wish you continued health and well-being. With regard to the above subject, please instruct banks operating in the southern governorates not to deal with inheritance restriction documents issued by Sharia courts in the southern governorates unless they are authenticated by the Office of the Chief Justice in Ramallah according to the proper procedures, and in accordance with the mechanism followed for sending documents through the committee formed by our decision in Gaza. No cash funds held by the bank in the Gaza Strip shall be distributed to heirs unless the inheritance restriction document is issued according to the legal procedures followed and authenticated by us, so that the documents are not subject to manipulation regarding the number or status of heirs according to proper procedures and the law, thereby protecting the rights of heirs in accordance with Islamic Sharia rulings.
