Resolution Measures Committee Decision on Withdrawal of TT Hellenic Postbank S.A. Authorisation

RESOLUTION MEASURES COMMITTEE Meeting 7/18.1.2013 Agenda item 3: Withdrawal of the authorisation of the credit institution by the name of “TT Hellenic Postbank S.A.” and placing thereof under liquidation THE RESOLUTION MEASURES COMMITTEE, having regard to: (a) Article 55A of the Statute of the Bank of Greece; (b) Act No. 6/8.1.2013 of the Executive Board of the Bank of Greece “Re￾establishment of the Resolution Measures Committee and assignment of responsibilities” (Government Gazette B 13); (c) Law 3601/2007 “Taking-up and pursuit of the business of credit institutions, capital adequacy of credit institutions and investment firms, and other provisions” (Government Gazette A 178), as currently in force, in particular Articles 63E, 68 and 69 para. 3 thereof; (d) Decision No. 21/2/4.11.2011 of the Credit and Insurance Committee “Regulation of special liquidation of credit institutions” (Government Gazette B 2498), as currently in force; (e) Bank of Greece Governor’s Act No. 2579/19.4.2006 “Authorisation of the banking société anonyme by the name of ‘TT Hellenic Postbank S.A.’”; (f) decision No. 2124/B95/18.01.2013 of the Minister of Finance establishing the interim credit institution by the name of “New TT Hellenic Postbank S.A.”, whereby assets and liabilities of the credit institution by the name of “TT Hellenic Postbank S.A.” where transferred to the former, pursuant to Annex 1 of the said decision; and

(g) the relevant recommendation, dated 18.01.2013, of the Credit Institutions Resolution Unit of the Bank of Greece, WHEREAS Following the establishment of the interim credit institution by the name of “New TT Hellenic Postbank S.A.” by the Decision No. 2124/B95/18.1.2013 of the Minister of Finance, the authorisation of the credit institution by the name “TT Hellenic Postbank S.A.” should be withdrawn pursuant to para. 4 of Article 63E of Law 3601/2007, HEREBY DECIDES AS FOLLOWS:

1. To withdraw the authorisation of the credit institution by the name of “TT Hellenic Postbank S.A.” to carry out the activities referred to in para. 1 of Article 11 of Law 3601/2007, and to place it under special liquidation in accordance with Article 68 of the said law.
2. Henceforth the said credit institution shall only be allowed to conduct strictly the operations necessary to serve the purpose of its liquidation. This decision shall be published in the Government Gazette and posted on the website of the Bank of Greece.
