The Council of the Central Bank of Montenegro issued this decision to mandate quarterly and annual statistical reporting from investment funds, investment fund management companies, and insurance companies. The regulation specifies electronic submission formats for balances, transactions, and securities analytics, with standard deadlines set at 30 days post-quarter and five months post-year-end. It also establishes confidentiality protections, data processing methodologies aligned with international standards, and a transitional deadline of 30 November 2024 for the first three quarters of 2024.
Pursuant to Article 35 paragraphs 4 and 5 and Article 44 paragraph 2 item 3 of the Central Bank of Montenegro Law (OGM 40/10, 6/13, 70/17, 125/23), at its meeting held on 31 July 2024, the Council of the Central Bank of Montenegro passed the following DECISION ON STATISTICAL DATA AND INFORMATION THAT INVESTMENT FUNDS, INVESTMENT FUND MANAGEMENT COMPANIES AND INSURANCE COMPANIES SUBMIT TO THE CENTRAL BANK OF MONTENEGRO Subject Matter Article 1 This decision prescribes the reporting entities obliged to submit statistical data and information to the Central Bank of Montenegro (hereinafter: the Central Bank) for the purposes of monetary and financial statistics (hereinafter: data and information), type and format of data and information, the submission manner and deadlines, confidentiality protection of data and information, and issues of importance for the collection, processing, dissemination, and publishing of data and information, as well as the reporting. Reporting entities Article 2 The reporting entities obliged to submit data and information are investment funds, investment fund management companies, and insurance companies. Type and format of data and information Article 3 Type and format of data and information that investment funds, investment fund management companies, and insurance companies are obliged to submit to the Central Bank are determined in the form of instruments indicated in the reporting forms in line with the “Guidelines on reports that investment funds, investment fund management companies, and insurance companies submit to the Central Bank of Montenegro” (hereinafter: Guidelines) attached hereto and making an integral part hereof. The Central Bank shall submit the following reporting forms to the reporting institutions in electronic format:
2 2) Reporting form “Structure of interest-bearing financial instruments” wherein reporting institutions shall report on interest on interest-bearing financial instruments; 3) Reporting form „Currency structure of balance sheet positions” wherein reporting institutions shall submit data on balances and transactions by given balance sheet positions per currency structure; 4) Reporting form „Securities analytics” wherein reporting institutions shall submit data on balances and transactions for each individual security per ISIN number for active balance sheet positions of securities. The Central Bank shall forward the reporting forms referred to in paragraph 2 above to reporting institutions no later than eight days following the entry into force of this decision and it shall update them, as necessary. The Central Bank shall publish the layout of the reporting forms under paragraph 2 above on its website. Where appropriate, the Central Bank may provide additional explanation for completing the reporting forms referred to above. Manner of submitting data and information Article 4 Reporting institutions shall submit to the Central Bank data and information specified in the reporting forms in electronic format in the form determined by the Central Bank. Upon the request of the Central Bank, a reporting institution shall provide certain data and information in hard copy as well. Deadlines for data and information submission Article 5 Reporting institutions shall submit data and information to the Central Bank by completing the following reporting forms:
3 The protection of confidential data and information shall be subject to the law governing the Central Bank operations, the law governing official statistics and the system of official statistics, and other regulations regulating confidentiality protection. Data and information processing, dissemination, and publishing Article 7 The Central Bank shall process data and information in line with the methodologies of the relevant international financial institutions and the European Union authorities, the methodology specified under the law governing the official statistics and the system of official statistics, and methods determined independently by the Central Bank in accordance with the law. The Central Bank shall disseminate the processed data and information in accordance with the law, signed agreements, and methods determined independently by the Central Bank in accordance with the law. The Central Bank shall publish public data and information on its website and in another appropriate manner. Postponed application Article 8 Notwithstanding Article 5 herein, reporting institutions shall submit data and information for the first, the second and the third quarter of 2024 to the Central Bank no later than until 30 November 2024. Memoranda of Understanding Article 9 The Central bank may collect data and information from investment funds and investment fund management companies through the Capital Market Authority, and information from insurance companies through the Insurance Supervision Agency, with whom it shall conclude Memoranda of Understanding thereof. Final provision Article 10 This decision shall enter into force on the eighth day following that of its publication in the Official Gazette of Montenegro.
