The Autorité des marchés financiers amended two automobile insurance endorsement forms to grant insurers discretion over deductible application. The updated Q.E.F. No. 4-8 and 4-8a endorsements permit insurers to apply the deductible either to any loss or exclusively to losses arising from a specified vehicle use. These amended forms may be utilized by all insurers between August 17, 2017 and April 1, 2018 prior to their official entry into force.
00 Notice regarding the coming into force on August 17, 2017 of amendments to two automobile insurance endorsement forms Under section 422 of An Act respecting insurance, CQLR, c. A-32, the Autorité des marchés financiers (the “AMF”) may prescribe the forms necessary for the application of this Act and must approve the form and the conditions of insurance policies relating to the ownership or use of automobiles. In order to reflect changing practices, the AMF is amending the following two automobile insurance endorsements: Q.E.F. No. 4-8 – Deductible property damage endorsement; Q.E.F. No. 4-8a – Deductible civil liability endorsement. The current versions of these endorsements do not allow insurers to determine when the deductible must apply. Under the amended versions, insurers will be able to choose between one of the following two options to determine when the deductible must be applied, i.e., whether: the deductible applies to any loss; the deductible applies solely to a loss that occurs when the vehicle is used for a purpose specified in the endorsement. These automobile insurance forms may be used by all insurers from August 17, 2017 to April 1, 2018, the date of entry into force of these amendments in clear language.
