Registration With Alternative Compliance for Non-U.S. Derivatives Clearing Organizations

The Commodity Futures Trading Commission proposes amendments to permit non-U.S. derivatives clearing organizations to register while complying with their home country regulatory regime instead of full U.S. rules. This alternative compliance framework applies to clearing organizations that do not pose substantial risk to the U.S. financial system and are in good regulatory standing in their home jurisdiction. Eligible entities must still adhere to specific U.S. customer protection safeguards and swap data reporting requirements while maintaining a satisfactory memorandum of understanding with their home country regulator.
