Process for a Designated Contract Market or Swap Execution Facility To Make a Swap Available to Trade, Swap Transaction Compliance and Implementation Schedule, and Trade Execution Requirement Under the Commodity Exchange Act

The Commodity Futures Trading Commission adopted final rules establishing a process for designated contract markets and swap execution facilities to determine when a swap is available to trade under the Commodity Exchange Act. The Commission also implemented a phased compliance schedule to provide additional time for market participants to meet the mandatory trade execution requirement for cleared swaps. These regulations, effective August 5, 2013, define the procedures and factors for making swaps available to trade and ensure alignment with Dodd-Frank Act mandates.
