Provision and Delivery of Information for Marketing of Financial Products and Services

The Financial Services Authority (OJK) issued Regulation No. 37/PADK.08/2025 to establish comprehensive and standardized guidelines for the provision and marketing delivery of information regarding financial products and services. Abstract: The Financial Services Authority Commissioner Council Regulation (PADK) is formulated to implement the mandate of Article 236 paragraph (3) of Law Number 4 of 2023 concerning the Development and Strengthening of the Financial Sector, and Article 29 paragraph (7) and Article 33 paragraph (9) of Financial Services Authority Regulation (POJK) Number 22 of 2023 concerning Consumer and Community Protection in the Financial Services Sector. This PADK provides more comprehensive and standardized guidelines regarding the provision of information, delivery of information for marketing, and the presentation of Product and/or Service Information Summaries in accordance with applicable legislation.

The legal basis for this PADK is: Law No. 21 of 2011 as amended by Law No. 4 of 2023; Law No. 4 of 2023 and POJK No. 22 of 2023.

This PADK regulates: a. the provision of product and service information; b. the delivery of information for the marketing of products and services; c. cooperation between Financial Service Providers (PUJK) and third parties in the provision and delivery of information for marketing products and services; and d. the documentation of product and service informational materials by PUJK.

Note: This PADK takes effect from the date of establishment. This PADK was established on December 2, 2025. Upon the entry into force of this PADK: a. Financial Services Authority Circular Letter Number 12/SEOJK.07/2014 concerning the Delivery of Information for the Marketing of Financial Products and/or Services; and b. Section V letters F and G of Financial Services Authority Circular Letter Number 5/SEOJK.05/2022 concerning Insurance Products Linked to Investment, are repealed and declared invalid.

Financial Service Providers (PUJK) must adjust their information summaries and advertisements no later than 6 (six) months from the effective date of this PADK, and 12 (twelve) months for private pawnshop companies.
