Position Limits for Derivatives

The Commodity Futures Trading Commission is reproposing rules to amend Part 150 of its regulations to establish speculative position limits for 25 exempt and agricultural commodity derivatives in compliance with the Dodd-Frank Act. The proposal updates definitions of bona fide hedging, revises exemptions from position limits, and extends reporting requirements for persons claiming such exemptions. Additionally, the Commission proposes processes for exchanges to recognize non-enumerated hedges and spread position exemptions, while delaying swap position limit requirements for entities lacking sufficient data access.
