Decision on the Manner and Time Limits for Submitting Data on the Complaints of Clients of Credit Institutions and Financial Service Users

The Council of the Central Bank of Montenegro issued this Decision to regulate how credit institutions and financial service providers submit client complaint data. Providers must report semi-annually using specified templates in electronic form, with deadlines set for July 15 and January 15. A one-time submission covering 2022 data was required by June 1, 2023, and the Decision entered into force eight days after its publication in the Official Gazette.

Pursuant to Article 44 paragraph 2 item 3 of the Central Bank of Montenegro Law (OGM 40/10, 6/13, 70/17) and Article 219 paragraphs 6 and 8 of the Law on Credit Institutions (OGM 72/19 and 8/21), the Council of the Central Bank of Montenegro, at its meeting held on 28 April 2023, passed the following DECISION on the manner and time limits for submitting data on the complaints of clients of credit institutions and financial service users Article 1 This Decision shall govern the manner and the time limits for submitting to the Central Bank of Montenegro (hereinafter: the Central Bank) the data on the complaints of clients of credit institutions or financial service users as set out in the law governing financial leasing, factoring, purchase of receivables, micro-Lending and credit-guarantee operations. Article 2 Credit institutions and financial service providers shall submit the data on the complaints of clients of credit institutions or financial service users referred to in Article 1 of this Decision on the templates which are attached to this Decision and make an integral part thereof. Data referred to in paragraph 1 of this Article shall be delivered to the Central Bank in electronic form, and, upon the Central Bank request in hard copy. Article 3 Credit institutions and financial service providers shall submit the data referred to in paragraph 1 of this Article on a semi-annual basis, specifically for a period:

  1. from 1 January to 30 June of the current year, until 15 July of the current year;
  2. from 1 July to 31 December of the previous year, until 15 January of the current year; Article 4 Notwithstanding Articles 2 and 3 of this Decision, for 2022, credit institutions and financial service providers shall submit to the Central Bank the data on complaints which shall include the data on the complainant and date of receipt of the complaint, the subject and the request contained in the complaint of a client of a credit institution or a financial service user, until 1 June 2023.
