The Danish Ministry of Employment issued this order to establish a detailed classification of industry subgroups for the Labour Market Occupational Insurance system based on main industry codes. It mandates that all employers and voluntarily insured persons be assigned to specific subgroups, with a formal appeal process available within four weeks for any disputes regarding these classifications. The regulation entered into force on January 1, 2021, replacing previous legislation and applying to contribution calculations from that year onward.
Pursuant to Section 58a, subsection 2, of the Act on Occupational Accident Insurance, cf. Statutory Order No. 376 of 31 March 2020, the following is prescribed upon the recommendation of the Board of the Labour Market Occupational Insurance:
Section 1. This Order establishes a subdivision of the main industry groups mentioned in Section 58a, subsection 1, of the Act, into a number of industry subgroups. A main industry group without industry subgroups is regarded as an industry subgroup. The industry subgroups are set out in Annex 1.
Subsection 2. The Labour Market Occupational Insurance assigns all employers and voluntarily insured persons to an industry subgroup, cf. Section 58a, subsections 1 and 2, of the Act, based on the company's main industry code (DB code).
Section 2. Appeals against decisions regarding industry division made by the Labour Market Occupational Insurance under this Order may, within a time limit of 4 weeks from the day the decision is notified, be brought before the appeal board established in accordance with Section 28 of the Act on Labour Market Supplementary Pension, cf. Section 45 of the Act on Occupational Accident Insurance. The address of the appeal board is: ATP Appeal Board, Holmens Kanal 20, 1060 Copenhagen K.
Section 3. This Order enters into force on 1 January 2021 and is used in the calculation of contributions from and including 2021.
Subsection 2. Statutory Order No. 1480 of 2 December 2016 on industry subgroups in the Labour Market Occupational Insurance is repealed.
