Oregon Insurance Division Bulletin INS 2008-2: Application of HB 2007 Domestic Partnership Legislation

The Oregon Insurance Division issued Bulletin INS 2008-2 to guide insurers on applying Oregon’s Domestic Partnership Legislation (HB 2007) to the Insurance Code. The bulletin mandates that domestic partnerships receive equivalent rights, benefits, and rating standards as marriages, while clarifying that insurers may still use gender-based actuarial data for underwriting. It further specifies that these state requirements apply to policy forms filed after February 4, 2008, and do not override federal laws such as the Defense of Marriage Act or ERISA savings provisions.
