Law 50 of July 2, 2003, Adding Chapter VI on Terrorism to Title VII of Book II of the Penal Code and Enacting Other Provisions

Adding Chapter VI, titled Terrorism, to Title VII of Book II of the Penal Code and enacting other provisions

THE LEGISLATIVE ASSEMBLY DECREES:

Article 1. Chapter VI, titled Terrorism, comprising Articles 264-A, 264-B, 264-C, 264-D, and 264-E, is added to Title VII, regarding Crimes against Collective Security, of Book II of the Penal Code, as follows:

Chapter VI Terrorism

Article 264-A. Whoever individually or as part of, acting in service of, or collaborating with armed bands, organizations, or groups, whose purpose is to subvert the constitutional order or seriously alter public peace, commits acts against persons, property, public services, or communication and transport media, which produce alarm, fear, or terror in the population or in a group or sector thereof, using explosives, toxic substances, weapons, fire, flooding, or any other violent means or means of mass destruction, shall be punished with imprisonment of 15 to 20 years.

Article 264-B. Whoever intentionally finances, subsidizes, conceals, or transfers money or goods to be used in the commission of any of the acts described in Article 264-A of this Code, even if they do not intervene in its execution or if the acts are not consummated, shall be punished with 15 to 20 years of imprisonment.

Article 264-C. The following shall be punished with imprisonment of 8 to 10 years:

  1. Whoever intentionally promotes or aids the activities carried out by persons or organized groups for the execution of any of the acts described in Article 264-A of this Code, even if they do not intervene in its realization.
  2. Whoever conceals, harbors, houses, or recruits persons for the execution of any of the acts described in Article 264-A of this Code, or who joins groups pursuing such purpose.

Article 264-D. Whoever, apart from the acts provided for in Article 264-A of this Code, promotes or executes acts that endanger the existence or physical integrity of the personnel of embassies, missions, or international representations accredited to the national government, or against their headquarters, physical structures, or property, which endanger the existence or physical integrity of any person, shall be punished with imprisonment of 10 to 15 years, without prejudice to other sanctions applicable according to this Code.

Article 264-E. Whoever has knowledge of the existence of persons or groups of persons who prepare or contribute to the planning or execution of the acts typified in Article 264-A of this Code or conceals the whereabouts of their perpetrators and intentionally omits to report the fact to the national authorities, shall be punished with imprisonment of 5 to 10 years.

Article 2. Number 5 is added to Article 127 of the Judicial Code, as follows:

Article 127. Superior Courts shall have jurisdiction in the first instance over the following proceedings: ... 5. Proceedings for crimes of terrorism. ...

Article 3. Non-profit associations shall be obligated to maintain control over the funds they receive, generate, or transfer. To this end, they must keep a detailed record of operations or financial transactions or donations that justify their origin or nature.

Article 4. This Law adds Chapter VI, titled Terrorism, comprising Articles 264-A, 264-B, 264-C, 264-D, and 264-E, to Title VII of Book II of the Penal Code and number 5 to Article 127 of the Judicial Code.

Article 5. This Law shall enter into force from its promulgation.
