Process for a Designated Contract Market or Swap Execution Facility To Make a Swap Available To Trade

The Commodity Futures Trading Commission proposes regulations to establish a process for designated contract markets and swap execution facilities to determine when a swap is available to trade under the Commodity Exchange Act. This further notice of proposed rulemaking responds to public comments regarding the implementation of Section 2(h)(8) of the Act, which mandates that cleared swaps be executed on these platforms unless they are not made available for trading. The proposed rules outline specific filing procedures and criteria for registered entities to certify swaps as available for trade, addressing concerns about market incentives and regulatory oversight.
