AGREEMENT declaring ineffective the Declaration of Subject to the Federal Public Domain Regime Number DSRDPF/023/2021 dated April 7, 2021, published in the Official Journal of the Federation on April 20, 2021.

AGREEMENT DECLARING INEFFECTIVE THE DECLARATION OF SUBJECT TO THE FEDERAL PUBLIC DOMAIN REGIME NUMBER DSRDPF/023/2021 DATED APRIL 7, 2021, PUBLISHED IN THE OFFICIAL JOURNAL OF THE FEDERATION ON APRIL 20, 2021.

Master Álvaro Lomelí Covarrubias, General Director of Federal Real Estate Asset Administration of the Institute of Administration and Appraisals of National Assets, an Administrative Body Decentralized of the Ministry of Finance and Public Credit, based on what is established by articles 27 of the Political Constitution of the United Mexican States; 2 fraction I, 17, 26 fraction VI, 31 fractions XXIX and XXX of the Organic Law of the Federal Public Administration; 2 fractions IV, VII and IX, 28 fractions I and III, 42 fraction XXVI, 101 fraction X, of the General Law of National Assets; 2, 3 fraction VI and 4 of the Law of the Official Journal of the Federation and Government Gazettes; 2 and 4 of the Federal Administrative Procedure Law; 4 section G, fraction V, 48 and 49 of the Internal Regulations of the Ministry of Finance and Public Credit; 1, 3 fractions VIII and X, 4 fraction I, subsection d), 5, 6 fractions XIX, XLVII and last paragraph, 7 fractions XV, XXII and XXV and 10 fractions I and XLVII of the Internal Regulations of the Institute of Administration and Appraisals of National Assets; and First of the Delegation Agreement, issued by the then President of the Institute of Administration and Appraisals of National Assets, published in the Official Journal of the Federation on March 8, 2017; and

CONSIDERING

That on April 20, 2021, the Declaration of Subject to the Federal Public Domain Regime was published in the Official Journal of the Federation, regarding the federal real estate properties indicated with Folio numbers:

DSRDPF/021/2021 to DSRDPF/040/2021, according to the Considerations contained therein, which:

" ...

1.- That article 27 of the Political Constitution of the United Mexican States provides that the ownership of the lands and waters included within the limits of the national territory belongs originally to the Nation, which has had and has the right to transmit the ownership thereof to individuals, constituting private property, having the Nation at all times the right to impose on private property the modalities dictated by public interest;

2.- That article 2, fraction VII of the General Law of National Assets defines "Federal Real Estate" as the land of the Federation with or without constructions, as well as those in which it exercises possession, control or administration as owner;

3.- That, for its part, article 6 fraction VI of the General Law of National Assets provides that federal real estate properties destined in fact or by means of a legal order to a public service and those real estate properties equated to them according to this Law are subject to the regime of federal public domain;

4.- That the Ministry of Agriculture and Rural Development has had possession, custody, surveillance and use of the federal real estate properties indicated below, for the use of public services under its charge, with the corresponding location, surface, measurements and boundaries, described in the following table:

5.- That, for the above reason, said real estate properties are identified as Federal real estate properties and are controlled in the System of Inventory of Federal and Paraestatal Real Estate Assets, with the Federal Real Estate Registries indicated in the previous table.

DECLARATION

FIRST.- That the real estate properties described in consideration 4 of this document are subject to the regime of federal public domain.

... "

That the Declaration referred to in the previous Consideration was issued based on the information contained in the Inventory Card of the System of Inventory of Federal and Paraestatal Real Estate Assets with Federal Real Estate Registry 2-5276-8.

That by Administrative Assignment Agreement dated January 31, 2018, issued by the General Secretary of Government of the state of Baja California, a surface of 182.80 square meters was assigned to the Ministry of Agriculture and Rural Development (SADER), of the property identified as Lot 8 of block 2, of the San Quintín City Subdivision, located in the Municipality of Ensenada, state of Baja California, San Quintín Delegation; said agreement had a validity of 5 years, which would take effect from January 31, 2018.

That by letter number 512-0930-2024 dated October 14, 2024, the General Directorate of Resources and Materials, Real Estate and Services of SADER requested the Directorate of Public Registry and Real Estate Control of the Institute of Administration and Appraisals of National Assets to remove from the System of Inventory of Federal and Paraestatal Real Estate Assets the real estate property known as " CADER San Quintín " ,

located at Tenth Street,

Fraction B, East Zone, No. Lot 8, Block 2, San Quintín Subdivision, C.P. 22940, Municipality of Ensenada,

Baja California, identified with Federal Real Estate Registry (R.F.I.) 2-5276-8.

That by letter number DI/684/2024 dated November 22, 2024, the aforementioned Directorate of Public Registry and Real Estate Control informed the General Directorate of Material Resources, Real Estate and Services of SADER of the impossibility of favoring a positive response to the request, so it was indicated the need to send its request to this General Directorate of Federal Real Estate Asset Administration (DGAPIF), since it is registered in the Federal Public Property Registry in Folio 153736, the Declaration of Subject to the Federal Public Domain Regime dated April 7, 2021.

That by letters numbers 512.-0032-2025, 512.01.01.-0317-2025, 512.01.01.-0552-2025 and 512.01.01.-0722- 2025, dated January 14, April 15, June 4 and November 3, all of 2025, the General Directorate of Material Resources, Real Estate and Services of SADER requested this Institute of Administration and Appraisals of National Assets to carry out the corresponding procedures to declare ineffective the Declaration of Subject to the Federal Public Domain Regime Number DSRDPF/023/2021 dated April 7, 2021, published in the Official Journal of the Federation on April 20, 2021, with respect to the real estate property with

R.F.I.

2-5276-8, known as " CADER San Quintín " , located at located at Tenth Street fraction B, East Zone, number

Lot 8, Block 2, San Quintín Subdivision, C.P. 22940 Municipality

of Ensenada, state of Baja California,

since said real estate property is property of the state of Baja California.

That by Certificate of Existence and Freedom from Encumbrance dated September 26, 2025, issued by the Department of Cadastre, of the Urban Administration Directorate of the Municipality of San Quintín, the ownership of lots 1, 2, 3, 4 and 5 fraction B and 8, 9 and 10 fraction B of Block 2, of the San Quintín City Subdivision, San Quintín Delegation, B.C., is accredited in the name of the Government of the state of Baja California.

That article 2 fraction VII of the General Law of National Assets states that lands or constructions owned by third parties that by virtue of some legal act the Federation possesses, controls or administers shall not be considered federal real estate properties.

Based on the study and analysis of the documentary background available in the Federal and Paraestatal Real Estate Information System, as well as the motivation presented that supports this Agreement and in order to comply with the request of the Ministry of Agriculture and Rural Development, I have deemed it appropriate to issue the following:

A G R E E M E N T

FIRST.- Notwithstanding that by the administrative assignment agreement indicated in consideration 3 a surface of 182.80 square meters was assigned to SADER, the Declaration of Subject to the Federal Public Domain Regime Number DSRDPF/023/2021 dated April 7, 2021, published in the Official Journal of the Federation on April 20, 2021, is declared ineffective, which was issued based on the information contained in the Inventory Card of the System of Inventory of Federal and Paraestatal Real Estate Assets with Federal Real Estate Registry 2-5276-8, with respect to the real estate property known as " CADER San Quintín " , located at located at Known Address, S/N, Ejido Nuevo Mexicali, C.P. S/N, Municipality of Ensenada, state of Baja California, with a surface of 421.39 square meters.

SECOND.- Publish this Agreement in the Official Journal of the Federation, so that it takes effect in terms of what is established by article 101 fraction X of the General Law of National Assets.

THIRD.- Register this Agreement as an act of legal certainty that the aforementioned Declaration of Subject to the Federal Public Domain Regime has become ineffective, with respect to the real estate property subject to it, in the Federal Public Property Registry, in accordance with what is provided by articles 42 fraction XXVI and 48 of the General Law of National Assets, for publicity purposes.

FOURTH.- The Institute of Administration and Appraisals of National Assets, within the scope of its attributes, will monitor the strict compliance with this Agreement.

TRANSITORY

ONLY.

This Agreement will enter into force the day after its publication in the Official Journal of the Federation.
