Agreement Declaring Ineligible Days for 2023 for Administrative Acts by the Institute of Administration and Appraisals of National Assets

The Institute of Administration and Appraisals of National Assets declares specific dates in 2023 as ineligible for administrative acts and procedures. The ineligible days are February 6, March 20, April 6 and 7, May 1 and 5, November 2 and 20, and December 25. Additionally, the days determined by the National Institute of Transparency, Access to Information and Personal Data Protection for information access requests are considered ineligible. Deadlines for procedures are suspended on these days, and the agreement entered into force on its publication date.

AGREEMENT by which the days of 2023 that will be considered as ineligible for the purposes of administrative acts and procedures processed by the Institute of Administration and Appraisals of National Assets are made known to the general public.

Internal Regulations of the

Ministry of Finance

and Public Credit;

and

fractions II

and IV

of the

Agreement by which the

Provisions are issued in the

matters of

Human Resources and

the Professional Career Service,

as well as the

General Application Administrative Manual

in the matter of

Human Resources and

Organization and the

Professional Career Service Manual, and;

CONSIDERING

That,

the Federal Administrative Procedure Law is the legal framework that regulates

the acts, procedures and resolutions of the

Federal Public Administration,

including its

disaggregated administrative bodies, which

establishes in its

article 28, that

administrative actions and diligences must be

conducted on

days and hours

that are not considered

such Saturdays and Sundays,

as well as January 1,

February 5,

March 21,

May 1,

May 5,

September 1

and 16,

November 20,

December 1 of each

six years,

when it corresponds to the

transmission of the

Federal Executive Power,

and December 25.

That,

the aforementioned Law also indicates as

ineligible days those

on which general vacations are held by the

competent authorities or on which

work is suspended, which will be made

known to the public through

an agreement issued by the Head of the

respective department, which

will be published in the Official Gazette of the Federation.

That,

article 4 of the Federal Administrative Procedure Law orders that administrative acts of

general character, such as

decrees, agreements and circulars,

among others, that

have as their object to establish

specific obligations, must be published in the

Official Gazette of the Federation to produce

legal effects.

That,

in accordance with

numeral 76, fractions II

and IV of the Agreement by which the

Provisions are issued in the

matters of

Human Resources and

the Professional Career Service, as well as the

General Application Administrative Manual

in the matter of

Human Resources and

Organization and the

Professional Career Service Manual, published in the

Official Gazette of the Federation

on July 12, 2010, and with

last reform on May 17, 2019,

the suspension of work must be published in the

Official Gazette of the Federation,

in order not to affect the

provision of services to the public.

That,

for the purposes of the

receipt, processing and handling of

information access requests made by

private parties, as well as of the

review resources in that

matter, the days

that are annually determined by the

National Institute of Transparency,

Access to Information and Protection of Personal Data,

through the

corresponding publication in the

Official Gazette of the Federation are considered

ineligible.

That,

with the purpose of providing

certainty and legal security to

private parties regarding the

procedures that are carried out before the

Institute of Administration and

Appraisals of National Assets,

in relation to the days on which

terms and deadlines regarding the

corresponding administrative procedures do not run,

it is necessary to make

known to the general public the

days that will be considered

ineligible in 2023, I have

deemed it appropriate to issue the following:

AGREEMENT

BY WHICH THE GENERAL PUBLIC IS MADE AWARE OF THE DAYS OF 2023,

THAT WILL BE CONSIDERED AS INELIGIBLE FOR THE PURPOSES OF THE

ACTS AND ADMINISTRATIVE PROCEDINGS PROCESSED BY THE

INSTITUTE OF ADMINISTRATION AND APPRAISALS OF NATIONAL ASSETS

ARTICLE ONE. -

For the purposes of the

acts and administrative procedures that in the exercise of their

attributions are carried out by the various

administrative units of the

Institute of Administration and Appraisals of

National Assets, the following

days of 2023 will be considered as ineligible:

a) February 6 (In commemoration of

February 5, Promulgation of the

Constitution of 1917);

b) March 20 (In commemoration of

March 21, Birthday of Benito Juárez);

c) April 6 and 7 (Holy Thursday and Good Friday);

d) May 1 and 5 (Labor Day and commemoration of the

Battle of Puebla, respectively);

e) November 2 and 20 (Day of the Faithful Departed and

Anniversary of the start of the

Mexican Revolution, respectively).

f) December 25 (Celebration of Christmas).

The foregoing, without prejudice to the faculty of this

Institute to enable the

days and hours that it requires for the

fulfillment of its attributions, as well as to assign the

guards of personnel that each of the

administrative units require.

ARTICLE TWO. -

On the days included in the

previous article, the deadlines that establish the

laws, agreements and other

applicable provisions, with respect to

the procedures and services under the charge of the

Institute of Administration and Appraisals of

National Assets, will not run.

ARTICLE THREE. -

In the attention of

information access requests by the

Transparency Unit, those days will be considered as

ineligible days that the

National Institute of Transparency,

Access to Information and Protection of Personal Data

made known through

publication in the Official Gazette of the Federation,

on January 3, 2023.

ARTICLE FOUR. -

The days of suspension of work corresponding to the

second vacation period of 2023,

will be made known in terms of

article 28 of the Federal Administrative Procedure Law and

taking as a basis the vacation period that the

Ministry of Public Education determines for the

2023-2024 academic year.

TRANSITORY

SINGLE. -

This agreement will enter into force on the

day of its publication in the

Official Gazette of the Federation.
