AGREEMENT designating to the Coordinating Body of Universities for the Welfare Benito Juárez García, the federal property known as "Fracción B El Tormento", with an area of 67,000.00 square meters, located at Carretera Federal Libre Escárcega-Villahermosa, kilometer 8.5, Postal Code 24350, Municipality of Escárcega, State of Campeche, with Federal Real Estate Registry number 4-3434-8.

A seal bearing the National Coat of Arms is placed at the margin, which reads: United Mexican States.- FINANCE.- Ministry of Finance and Public Credit.- Institute of Administration and Appraisal of National Assets.- DST-01/2024.

VÍCTOR JULIÁN MARTÍNEZ BOLAÑOS, President of the Institute of Administration and Appraisal of National Assets, a decentralized administrative body of the Ministry of Finance and Public Credit, based on the provisions of articles 2, fraction I, 17, 26, 31, fractions XXIX and XXX of the Organic Law of the Federal Public Administration; 2, fractions II, IV, V, VI and VII, 3, fraction III, 4, first and second paragraphs, 6, fraction XXI, 11, fraction I, 13, 28, fractions I, III and VII, 29, fractions I and V, 61, 62, 66, 70 and 101, fraction V of the General Law of National Assets; 4, section G, fraction V, 48 and 49 of the Internal Regulations of the Ministry of Finance and Public Credit; and 1, 3, fractions VIII, IX and X, 4, fraction I, subsection a) and 6, fractions XXVI and XXXIII of the Regulations of the Institute of Administration and Appraisal of National Assets;

I deem it appropriate to issue this agreement, taking into account the following:

CONSIDERING

FIRST. - That within the assets subject to the public domain regime of the Federation, is the federal property known as "Fracción B El Tormento", with Federal Real Estate Registry number 4-3434-8, with an area of 67,000.00 square meters, located at Carretera Federal Libre Escárcega-Villahermosa, kilometer 8.5, Postal Code 24350, Municipality of Escárcega, State of Campeche.

SECOND. - That the ownership of the federal property described in the preceding Consideration is accredited through Declaration number D.R.-004-2023 dated December 4, 2023, by which it is determined that the property described in the First Consideration is reverted to the patrimony of the Federation, published in the Official Gazette of the Federation on December 12, 2023, which is registered in the Federal Property Public Registry under Real Folio 50246/3 dated December 12, 2023.

THIRD. - That Topographic Plan number TOP-01, prepared at a scale of 1:1000, approved, registered and certified on October 11, 2023, by the Directorate of Public Registry and Real Estate Control, attached to the General Directorate of Real Estate Policy and Management of this Institute of Administration and Appraisal of National Assets, under number DRPCI/7211/4-3434-8/2023/T, records the area, measurements and boundaries of the property in question.

FOURTH. - That through official letter number OCUBBJG/DG/314/2023 dated July 28, 2023, the General Directorate of the Coordinating Body of Universities for the Welfare Benito Juárez García, requested the donation of the federal property described in the First Consideration of this Agreement, in order to provide, develop, coordinate and orient services for the delivery of quality higher education, through the installation of an educational headquarters in the Municipality of Escárcega, Campeche, where the Agroforestry Engineering degree is offered.

FIFTH. - That according to the Land Use License dated August 14, 2023, issued by the Directorate of Public Works, Urban Development and Environment of the Municipality of Escárcega, State of Campeche, the feasibility of use or destination as an Experimental and Educational Field is authorized.

SIXTH. - That through Alignment Certificate dated August 14, 2023, the Directorate of Public Works, Urban Development and Environment of the Municipality of Escárcega, State of Campeche, stated that the property subject to this Agreement is located in the Rural Zone Campeche-Escárcega, Municipality of Escárcega, State of Campeche, which is correctly aligned.

SEVENTH. - That through official letter number 1580-C/1184 dated September 18, 2023, the Directorate of Architecture and Conservation of Immovable Artistic Heritage of the National Institute of Fine Arts and Literature, informed that the property indicated in the First Consideration of this Agreement is not considered an artistic monument or of artistic value.

EIGHTH. - That through official letter number 401.3S.17-2023/3102 dated October 2, 2023, the Directorate of the INAH Campeche Center of the National Institute of Anthropology and History, ruled that the property described in the First Consideration of this Agreement is not a historical monument, is not adjacent to a historical monument and is not located in a zone of historical or archaeological monuments.

NINTH. - That in view of the fact that the integration of all the documentation provided for the issuance of the Administrative Agreement on Disincorporation and authorization of gratuitous alienation of the property indicated in the First Consideration of this Agreement has been carried out, and it is pending to submit it to the Committee on Real Estate Utilization (CAI), and since it is a priority project of the Presidency of the Republic, in order for that Coordinating Body of Universities for the Welfare Benito Juárez García to be able to start occupying the federal property and develop the project for the installation of an educational headquarters in the Municipality of Escárcega, State of Campeche, it has been determined to grant the property through an Administrative Agreement on Destination, while the Committee on Real Estate Utilization, as appropriate, agrees on the approval for the issuance of the Administrative Agreement on Disincorporation and authorization of gratuitous alienation.

TENTH. - That the General Directorate of Administration of Federal Real Estate Patrimony of the Institute of Administration and Appraisal of National Assets, in accordance with what is provided by article 11, fraction V, of the Regulations of this Institute, knew and reviewed from a technical-legal point of view, the operation that is authorized. The legal and technical documentation that supports the legal and administrative situation of the property, as well as of this Agreement, is in the procedural file integrated by said General Directorate and was duly integrated and collated with that which is in the Federal and Parastatal Real Estate Information System. Likewise, and based on article 9, fraction XIV in relation to article 11, fraction V of the Regulations of the Institute, the Legal Unit issued a favorable opinion regarding this Agreement.

Therefore, and in accordance with the provisions established in articles 61, 62, 66 and 70 of the General Law of National Assets, and being the purpose of the Federal Executive the optimal use of federal real estate patrimony, privileging public institutions of different levels of Government with federal properties for the provision of public services under their charge, I have deemed it appropriate to issue the following:

AGREEMENT

FIRST. - The federal property known as "Fracción B El Tormento", with an area of 67,000.00 square meters, with Federal Real Estate Registry number 4-3434-8, located at Carretera Federal Libre Escárcega-Villahermosa, kilometer 8.5, Postal Code 24350, Municipality of Escárcega, State of Campeche, is designated to the Coordinating Body of Universities for the Welfare Benito Juárez García, for the installation of an educational headquarters in the Municipality of Escárcega, State of Campeche, in which the Agroforestry Engineering degree is offered, until such time as the Committee on Real Estate Utilization, as appropriate, agrees on the approval for the issuance of the Administrative Agreement on Disincorporation and authorization of gratuitous alienation.

SECOND. - The Institute of Administration and Appraisal of National Assets will carry out the physical, legal and administrative delivery of the property that is designated in this act to the Coordinating Body of Universities for the Welfare Benito Juárez García.

THIRD. - If the Coordinating Body of Universities for the Welfare Benito Juárez García gives the federal property that is designated a use different from that established by this Agreement, without the prior authorization of the Ministry of Finance and Public Credit, through the Institute of Administration and Appraisal of National Assets; or if it ceases to use or need it, said asset with all its improvements and accessories will be withdrawn from its service to be administered directly by this Institute, in accordance with article 68 of the General Law of National Assets.

FOURTH. - In case construction, reconstruction, modification, adaptation, conservation, maintenance, repair and demolition works are projected in the designated property, prior to its realization, the Coordinating Body of Universities for the Welfare Benito Juárez García must manage before the authorities of the corresponding levels of government the obtaining of licenses, permits, authorizations or any other similar that is required.

FIFTH. - The Coordinating Body of Universities for the Welfare Benito Juárez García must safeguard and monitor the property, being obliged to cover the necessary expenses for its conservation and maintenance, and other inherent services that, as appropriate, are generated, as well as the corresponding insurance against damage to the property, in accordance with what is provided in articles 32, fraction IV and 66 of the General Law of National Assets.

SIXTH. - The destination only confers to the Coordinating Body of Universities for the Welfare Benito Juárez García the right to use the designated property for the authorized use, but does not transmit ownership of it, nor grants any real right over it, in accordance with article 70 of the General Law of National Assets.

SEVENTH. - The Institute of Administration and Appraisal of National Assets, within the scope of its attributes, will monitor the strict compliance with this Agreement. This Agreement will enter into force the day following its publication in the Official Gazette of the Federation.
