Agreement Designating Federal Property Pagés Llergo 202 to the Secretariat of the Interior

The Agreement designates the federal property known as "Pagés Llergo 202," located in Tabasco with an area of 421.26 square meters, to the Secretariat of the Interior for continued use as offices for its Federal Delegation in Tabasco. The Secretariat of the Interior is obligated to cover maintenance and insurance costs, must obtain necessary permits for any construction or modification, and must seek prior authorization from the Secretariat of Finance and Public Credit if the use of the property changes or if it ceases to need it. The designation grants usage rights only and does not transfer ownership, with the Institute of Administration and Appraisal of National Assets responsible for monitoring compliance. This Agreement entered into force on August 14, 2024, the day following its publication in the Official Gazette of the Federation.

AGREEMENT designating to the Secretariat of the Interior the federal property known as "Pagés Llergo 202", with an area of 421.26 square meters, located at Avenida José Pagés Llergo number 202, Nueva Villahermosa Neighborhood, Postal Code 86070, Centro Municipality, Tabasco State, with Federal Real Estate Registry 27-4234-0.

VÍCTOR JULIÁN MARTÍNEZ BOLAÑOS, President of the Institute of Administration and Appraisal of National Assets, a Decentralized Administrative Organ of the Secretariat of Finance and Public Credit, based on the provisions of Articles 2, fraction I, 17, 26, 31, fractions XXIX and XXX of the Organic Law of the Federal Public Administration; 2, fractions II, IV, V, VI and VII, 3, fraction III, 4, first and second paragraphs, 6, fraction XXI, 11, fraction I, 13, 28, fractions I, III and VII, 29, fractions I and V, 61, 62, 66, 70 and 101, fraction V of the General Law of National Assets; 4, paragraph G, fraction V, 48 and 49 of the Internal Regulations of the Secretariat of Finance and Public Credit; and 3, fractions VIII, IX and X, 4, fraction I, subsection a) and 6, fractions XXVI and XXXIII of the Regulations of the Institute of Administration and Appraisal of National Assets; and taking into account the following:

CONSIDERING

FIRST. - That among the assets subject to the public domain regime of the Federation, is the federal property known as "Pagés Llergo 202", with an area of 421.26 square meters, with Federal Real Estate Registry 27-4234-0, located at Avenida José Pagés Llergo number 202, Nueva Villahermosa Neighborhood, Postal Code 86070, Centro Municipality, Tabasco State.

SECOND. - That the ownership of the federal property described in the preceding Consideration is accredited through public deed number 925 dated July 7, 1956, granted by Licentiate Florizel Pereznieto Priego, Public Notary number three of the State of Tabasco, in which the sale of an area of 450 square meters by the then Secretariat of Hydraulic Resources is recorded, which is registered in the Federal Public Property Registry under Real Folio number 10239 dated March 25, 1982, which corresponds to a fraction of the property in question with an area of 408.58 square meters; regarding the fraction with an area of 12.68 square meters, the Federation exercises possession.

That public deed number 925 dated July 7, 1956, was ratified and validated through Agreement with Folio number 097/2014 dated September 3, 2014, registered in the Federal Public Property Registry, under Real Folio number 10239/1 dated September 9, 2014.

THIRD. - That Topographic Plan number 27-4234-0/2013, prepared at a scale of 1:100, approved, registered and certified on July 31, 2014, by the Directorate of Public Registry and Real Estate Control of the Institute of Administration and Appraisal of National Assets under number DRPCI/27-4234-0/5342/2014/T, records the area, measurements and boundaries of the property in question, with an area of 421.26 square meters; noted in its notes table that,

"The result of the topographic survey yielded an area of 421.26 m2 and the property antecedent indicates 450.00 m2, which results in a difference (Deficit) of 28.74 m2, which is justified according to the following summary table of areas:

Area to regularize: + 421.26 M2 Area of Affection 1 (Av. Pagés Llergo): + 30.37 M2 Area of Affection 2 (lot 76): + 11.05 M2: Excess area (Alfonso Tarecena street):

12.68 M2: Antecedent area (sum): 450.00 M2:

FOURTH. - That by letter number UAF/DGRMSG/339/2019 dated March 26, 2019, the General Director of Material Resources and General Services and Real Estate Responsible of the Secretariat of the Interior, requested that the designation of the federal property described in the First Consideration of this Agreement be granted, to continue using it as offices for the Federal Delegation in Tabasco.

FIFTH. - That by letter number DOOTSM/SRYGU/1784/2023 dated March 31, 2023, the Directorate of Works, Territorial Planning and Municipal Services of the Constitutional City Council of Centro, State of Tabasco, issues the Land Use Certificates: Commercial and Central Service Corridor (CC) and based on the Zoning Regulations of the Municipality of Centro, State of Tabasco, the requested land use for Government offices is compatible; and Certificate of Alignment and Official Number Assignment: Avenida José Pagés Llergo number 202, Nueva Villahermosa Neighborhood, Villahermosa, Postal Code 86070, Centro Municipality, Tabasco State.

SIXTH. - That by letter number UAF/DGRMySG/0515/2023 dated May 03, 2023, the General Director of Material Resources and General Services and Real Estate Responsible of the Secretariat of the Interior, stated under oath, that based on the documentary background of the file available, the age of the property subject to this Agreement, and its architectural composition, it is considered that it does not have the characteristics established in the relevant Law to be considered a Historical or Artistic Monument, in compliance with Criterion number 2/2011, of the Committee for Federal and Para-statal Real Estate Heritage, published in the Official Gazette of the Federation on January 19, 2012.

SEVENTH. - That the General Directorate of Administration of Federal Real Estate Heritage of the Institute of Administration and Appraisal of National Assets, in accordance with Article 11, fraction V, of the Regulations of this Institute, knew and reviewed from a technical-legal point of view the operation authorized. The legal and technical documentation supporting the legal and administrative situation of the property, as well as of this Agreement, is in the procedural file integrated by said General Directorate and was duly compared with that in the Federal and Para-statal Real Estate Information System.

Likewise, based on Article 9, fraction XIV in relation to Article 11, fraction V of the Institute's Regulations, the Legal Unit issued an opinion deeming the present Agreement appropriate.

Therefore, and in accordance with the provisions established in Articles 61, 62, 66 and 70 of the General Law of National Assets, and being the purpose of the Federal Executive the optimal use of federal real estate heritage, prioritizing public institutions of different levels of Government with federal properties for the provision of public services under their charge, I have deemed it appropriate to issue the following:

AGREEMENT

FIRST. - The federal property known as "Pagés Llergo 202" located at Avenida José Pagés Llergo number 202, Nueva Villahermosa Neighborhood, Postal Code 86070, Centro Municipality, Tabasco State, with Federal Real Estate Registry 27-4234-0, is designated to the Secretariat of the Interior for it to continue using it as offices for its Federal Delegation in Tabasco.

SECOND. - If the Secretariat of the Interior gives the federal property designated to it a use different from that established by this Agreement, without prior authorization from the Secretariat of Finance and Public Credit, through the Institute of Administration and Appraisal of National Assets; or if it ceases to use or need it, said asset with all its improvements and accessions will be withdrawn from service to be administered directly by this Institute, in accordance with Article 68 of the General Law of National Assets.

THIRD. - In case construction, reconstruction, modification, adaptation, conservation, maintenance, repair and demolition works are planned for the designated property, prior to their realization, the Secretariat of the Interior must request from local and federal authorities the obtaining of licenses, permits, authorizations or any other similar that may be required.

FOURTH. - The Secretariat of the Interior must guard and supervise the property, being obliged to cover the necessary expenses for its conservation and maintenance, and other inherent services that may arise, as well as the corresponding insurance against damage to the property, in accordance with Articles 32, fraction IV and 66 of the General Law of National Assets.

FIFTH. - The designation only confers upon the Secretariat of the Interior the right to use the designated property for the authorized use, but does not transfer ownership of it, nor grants any real right over it, in accordance with Article 70 of the General Law of National Assets.

SIXTH. - The Institute of Administration and Appraisal of National Assets, within the scope of its attributes, through the General Directorate of Administration of Federal Real Estate Heritage, will monitor strict compliance with this Agreement.

This Agreement will enter into force the day following its publication in the Official Gazette of the Federation.
