Agreement Designating the Federal Property 'Subprocuraduría de Derechos Humanos' to the Attorney General's Office

The agreement designates the federal property known as 'Subprocuraduría de Derechos Humanos', located at Calle López number 12 in Mexico City, to the Attorney General's Office for use as administrative offices. with an area of 1,625.00 square meters,

located at Calle López number 12, Colonia Centro, Postal Code 06050, Cuauhtémoc Municipality,

Mexico City, with Federal Real Estate Registry 9-17637-3.

VÍCTOR JULIÁN MARTÍNEZ BOLAÑOS, President of the Institute of Administration and Appraisal of National Assets, a decentralized administrative body of the Ministry of Finance and Public Credit, based on the provisions of Articles 2, fraction I, 17, 26, 31, fractions XXIX and XXX of the Organic Law of the Federal Public Administration; 2, fractions II, IV, V, VI and VII, 3, fraction III, 4, paragraphs first and second, 6, fraction XXI, 11, fraction I, 13, 28, fractions I, III and VII, 29, fractions I and V, 61, 62, 66, 70 and 101, fraction V of the General Law of National Assets; 4, section G, fraction V, 48 and 49 of the Internal Regulations of the Ministry of Finance and Public Credit; and 3, fractions VIII, IX and X, 4, fraction I, subsection a) and 6, fractions XXVI and XXXIII of the Regulations of the Institute of Administration and Appraisal of National Assets; and taking into account the following:

CONSIDERATIONS

FIRST.- That among the assets subject to the public domain regime of the Federation, is the federal property known as "Subprocuraduría de Derechos Humanos", with an area of 1,625.00 square meters, with Federal Real Estate Registry 9-17637-3, located at Calle López number 12, Colonia Centro, Postal Code 06050, Cuauhtémoc Municipality, Mexico City.

SECOND.- That the ownership of the federal property described in the preceding Consideration is evidenced by public deed number 44 dated October 31, 1967, granted before the notary public Licentiate Rodolfo Charles Sierra, Public Notary Number 44 of the Federal District and National Heritage, through which the sales contract celebrated between, on one part, the Federal Government, as the buying party, and "Seguros de México Bancomer", S.A., as the selling party, is recorded. This document is registered in the Federal Property Registry under Real Folio 27485 dated May 18, 1990.

THIRD.- That topographic plan number TOPOLOP-12-01, prepared at a scale of 1:200, registered on July 16, 2012, under number DRPCI-4175-2012-T and certified on September 12, 2012, by the Directorate of Public Registry and Real Estate Control attached to the General Directorate of Real Estate Policy and Management of the Institute of Administration and Appraisal of National Assets, records the area, measurements, and boundaries of the property in question, stating in its notes table that, "... THROUGH REGISTRATION AND CADASTRE OF THE FEDERAL PROPERTY, IT MANIFESTS AN AREA OF 1625.00 M2, HOWEVER A SURVEY CARRIED OUT YIELDS AN AREA OF 1618.28 M2".

FOURTH.- That by official letter number FGR/OM/DGRMSG/899/2023 dated September 26, 2023, the General Director of Material Resources and General Services and Real Estate Manager of the Attorney General's Office, requested the issuance of the Administrative Agreement for the Destination of the federal property described in the First Consideration of this Agreement, to be used as administrative offices.

FIFTH.- That by official letter number 401.3S.1-2023/2807 dated October 3, 2023, the Director of Authorizations and Inspections of the National Coordination of Historical Monuments of the National Institute of Anthropology and History, informed that the property subject to this Agreement, "... is not considered a historical monument, is not adjacent to any of them, however, it is located within perimeter "B" of the Zone of Historical Monuments, known as "Historic Center of Mexico City", decreed and published in the Official Gazette of the Federation on April 11, 1980.

Therefore, any work carried out on the property in question must have prior authorization from the National Institute of Anthropology and History."

SIXTH.- That by Certificate of Alignment and/or Official Number dated October 3, 2023, the Subdirectorate of Manifestations, Construction Licenses and Urban Development, of the Ministry of Urban Development and Housing of the Government of Mexico City, issues a certificate of the official number assigning 12 for the property located at Calle López, Colonia Centro, Territorial Demarcation Cuauhtémoc.

SEVENTH.- That by Request for Information on Properties with Artistic Value or Artistic Monument, with seal and folio number 1783 dated October 4, 2023, the Directorate of Architecture and Conservation of Immovable Artistic Heritage of the National Institute of Fine Arts and Literature (INBAL), informed that the property subject to this instrument is not included in the INBA List; stating in the observations section that: "BY ADJOINING PROPERTIES OF ARTISTIC VALUE (JUAREZ 14 AND LAZARO CARDENAS 9) THE PROTECTION OF THE SAME IS RECOMMENDED." (sic)

EIGHTH.- That by Single Certificate of Land Use Zoning dated November 23, 2023, with folio number 34746-151GOSA23, the Certifier of the Directorate of the Registry of Plans and Programs of the Ministry of Urban Development and Housing, of the Government of Mexico City, determined that, "... the zoning applicable to the property or real estate in question is: E (Equipment)."

NINTH.- That by Act of Physical, Legal, Administrative and Provisional Handover dated February 1, 2024, the Ministry of Finance and Public Credit, through its decentralized administrative body, the Institute of Administration and Appraisal of National Assets, through the General Directorate of Administration of Federal Real Estate Heritage, "... determined it appropriate to provisionally deliver "THE FEDERAL PROPERTY" to "THE FGR" so that it may use it as administrative offices, prior to work that guarantees the safety of "THE FEDERAL PROPERTY" and the people.", registered in the Federal Property Registry under Real Folio number 27485/4 dated June 3, 2024.

TENTH.- That the General Directorate of Administration of Federal Real Estate Heritage of the Institute of Administration and Appraisal of National Assets, in accordance with Article 11, fraction V, of the Regulations of this Institute, knew and reviewed from a technical-legal point of view the operation authorized. The legal and technical documentation supporting the legal and administrative situation of the property, as well as of this Agreement, is in the procedural file integrated by said General Directorate and was duly compared with that held in the Federal and Para-statal Real Estate Information System. Likewise, based on Article 9, fraction XIV in relation to Article 11, fraction V of the Institute's Regulations, the Legal Unit issued an opinion deeming the present Agreement appropriate.

Therefore, and in conformity with the provisions established in Articles 61, 62, 66 and 70 of the General Law of National Assets, and being the purpose of the Federal Executive, the optimal use of federal real estate heritage, prioritizing public institutions of different levels of government with federal properties for the provision of public services under their charge, I have deemed it appropriate to issue the following:

AGREEMENT

FIRST.- The federal property known as "Subprocuraduría de Derechos Humanos" located at Calle López number 12, Colonia Centro, Postal Code 06050, Cuauhtémoc Municipality, Mexico City, with Federal Real Estate Registry 9-17637-3, with an area of 1,625.00 square meters, is designated to the Attorney General's Office, to continue using it as administrative offices.

SECOND.- If the Attorney General's Office gives the federal property designated to it a use different from that established by this Agreement, without prior authorization from the Ministry of Finance and Public Credit, through the Institute of Administration and Appraisal of National Assets; or if it ceases to use or need it, said asset with all its improvements and accessions will be withdrawn from its service to be administered directly by this Institute, in accordance with the provisions of Article 68 of the General Law of National Assets.

THIRD.- In case construction, reconstruction, modification, adaptation, conservation, maintenance, repair, and demolition works are planned for the designated property, prior to their realization, the Attorney General's Office must manage before local and federal authorities the obtaining of licenses, permits, authorizations, or any other similar requirements.

FOURTH.- The Attorney General's Office must guard and supervise the property, being obliged to cover the necessary expenses for its conservation and maintenance, and other inherent services that may arise, as well as the corresponding insurance against damage to the property, in accordance with the provisions of Articles 32, fraction IV and 66 of the General Law of National Assets.

FIFTH.- The designation only confers upon the Attorney General's Office the right to use the designated property for the authorized use, but does not transfer ownership of it, nor grants any real right over it, in accordance with the provisions of Article 70 of the General Law of National Assets.

SIXTH.- The Institute of Administration and Appraisal of National Assets, within the scope of its attributes, through the General Directorate of Administration of Federal Real Estate Heritage, will monitor strict compliance with this Agreement.

This Agreement will enter into force the day following its publication in the Official Gazette of the Federation.
