Agreement Determining Inhabile Days for Administrative Acts and Procedures Before the National Banking and Securities Commission

The agreement establishes specific dates as inhabile days for administrative acts and procedures before the National Banking and Securities Commission (CNBV), in addition to weekends. The designated inhabile periods include December 21, 2020, to January 5, 2021, and specific dates throughout 2021 corresponding to Mexican constitutional holidays and other fixed observances. This determination applies to entities and persons subject to CNBV supervision, as well as to authorities and the general public. The agreement entered into force the day following its publication in the Official Gazette of the Federation on December 10, 2020.

AGREEMENT determining the days that will be considered as inhabile for the purposes of administrative acts and procedures that are processed or should be processed before the National Banking and Securities Commission, by entities and persons subject to the supervision of said Commission, as well as by authorities and the general public.

On the margin is a seal with the National Coat of Arms, which reads: United Mexican States.- MINISTRY OF FINANCE.- Ministry of Finance and Public Credit.

The National Banking and Securities Commission, based on articles 14 and 16, fraction I of the Law of the National Banking and Securities Commission and in terms of what is provided by article 4 and 28 of the Federal Administrative Procedure Law and other applicable legal provisions, as well as in Article Three, numeral 76 of the Agreement by which the Provisions in the areas of Human Resources and Professional Career Service are issued, as well as the General Administrative Manual in the matter of Human Resources and Organization and the Professional Career Service Manual, published in the Official Gazette of the Federation on July 12, 2010, as well as its reforms, and

CONSIDERATIONS

That the Federal Administrative Procedure Law is the legal framework that regulates the acts, procedures, and resolutions of the Federal Public Administration, including its decentralized administrative bodies, and

That with the aim of providing certainty and legal security to entities and private parties subject to the supervision of the National Banking and Securities Commission, as well as to other authorities and the general public, regarding the administrative acts and procedures carried out before this Commission, it is necessary to establish the days on which deadlines and terms will not run within said procedures; it has resolved to issue the following:

AGREEMENT BY WHICH THE DAYS THAT WILL BE CONSIDERED AS INHABILE ARE DETERMINED FOR THE PURPOSES OF ADMINISTRATIVE ACTS AND PROCEDURES THAT ARE PROCESSED OR SHOULD BE PROCESSED BEFORE THE NATIONAL BANKING AND SECURITIES COMMISSION, BY ENTITIES AND PERSONS SUBJECT TO THE SUPERVISION OF SAID COMMISSION, AS WELL AS BY AUTHORITIES AND THE GENERAL PUBLIC

SINGLE. The following will be considered as inhabile days, for the purposes of administrative acts and procedures that are processed or should be processed before the National Banking and Securities Commission, in addition to Saturdays and Sundays:

I. From December 21, 2020, to January 5, 2021.

II. The first Monday of February 2021 in commemoration of February 5.

III. The third Monday of March 2021 in commemoration of March 21.

IV. April 1 and 2, 2021.

V. May 1, 2021.

VI. May 5, 2021.

VII. September 16, 2021.

VIII. November 2, 2021.

IX. The third Monday of November 2021 in commemoration of November 20.

TRANSITIONAL PROVISIONS

FIRST. Publish in the Official Gazette of the Federation.

SECOND. This agreement will enter into force the day following its publication in the Official Gazette of the Federation.
