Agreement Determining Non-Business Days for Administrative Acts and Procedures Before the National Banking and Securities Commission by Supervised Entities, Persons, Authorities, and the General Public

This Agreement establishes specific dates to be considered non-business days for administrative acts and procedures processed before the National Banking and Securities Commission by supervised entities, persons, authorities, and the general public. The designated non-business periods include December 18 to 22 and December 25 to 29, 2023, January 1 to 2, 2024, and various civic and statutory holidays throughout 2024 such as February 5, March 21, Holy Week, May 1, May 5, September 16, October 1, and November 2 and 20. Deadlines for the Commission to acknowledge or resolve procedures are suspended during these days, including natural day deadlines between December 18, 2023, and January 2, 2024, and the Agreement enters into force the day following its publication in the Official Gazette of the Federation.

AGREEMENT determining the days that will be considered as non-business days for effects of the administrative acts and procedures that are processed or must be processed before the National Banking and Securities Commission by the entities and persons subject

In the margin a seal with the National Shield, reading: United Mexican States.- TREASURY.- Secretariat of the Treasury and Public Credit.- National Banking and Securities Commission.

The National Banking and Securities Commission based on articles 14 and 16, first paragraph, Section I of the Law of the National Banking and Securities Commission, and in terms of what is provided for by articles 4 and 28, second paragraph of the Federal Law of Administrative Procedure, as well as in the Third Article, numeral 76 of the Agreement issuing the Provisions in matters of Human Resources and the Professional Career Service, as well as in the Administrative Manual of General Application in matters of Human Resources and Organization and the Manual of the Professional Career Service, published in the Official Gazette of the Federation on July 12, 2010 and its reforms, and

CONSIDERATIONS

That with the purpose of providing certainty and legal security to the entities and individuals subject to the supervision of the National Banking and Securities Commission, as well as to other authorities and the general public regarding the administrative acts and procedures that are carried out before this Commission, it is necessary to establish the days that will be considered non-business days and deadlines and terms will not run within said procedures, it has resolved to issue the following:

AGREEMENT DETERMINING THE DAYS TO BE CONSIDERED AS NON-BUSINESS DAYS FOR EFFECTS OF ADMINISTRATIVE ACTS AND PROCEDURES THAT ARE PROCESSED OR MUST BE PROCESSED BEFORE THE NATIONAL BANKING AND SECURITIES COMMISSION BY THE ENTITIES AND PERSONS SUBJECT TO THE SUPERVISION OF SAID COMMISSION, AS WELL AS BY THE AUTHORITIES AND GENERAL PUBLIC

SOLE.- The following days shall be considered as non-business days for effects of the administrative acts and procedures that are processed or must be processed before the National Banking and Securities Commission, in addition to Saturdays and Sundays:

I. From 18 to 22 and from 25 to 29 of December of 2023 and from 1st to 2 of January of 2024.

II. The first Monday of February of 2024 in commemoration of February 5.

III. The third Monday of March of 2024 in commemoration of March 21.

IV. The 28 and 29 of March of 2024.

V. The 1st of May of 2024.

VI. The 5 of May of 2024.

VII. The 16 of September of 2024.

VIII. The 1st of October of 2024.

IX. The 2 of November of 2024 and the third Monday of said month in commemoration of November 20.

On the non-business days and periods comprised in this Agreement deadlines shall be understood as suspended for the Commission to take cognizance or resolve accordingly regarding the applications or procedures that are managed before it.

In the period comprised between December 18, 2023 to January 2, 2024, deadlines fixed in calendar days shall be understood as suspended for the Commission to resolve accordingly regarding the applications or procedures that are managed before it and that are in the process of being attended to.

TRANSITORY ARTICLES

FIRST.- Publish in the Official Gazette of the Federation.

SECOND.- This Agreement shall enter into force the day following its publication in the Official Gazette of the Federation.
