Agreement eliminating and establishing administrative simplification and improvement actions for procedures before the Ministry of Finance and Public Credit

The Ministry of Finance and Public Credit merges two procedures for requesting certified and simple electronic copies of documents from the Public Registry of Decentralized Entities (REPODE) into a single procedure (SHCP-04-001). The maximum resolution deadline for certified copy requests is reduced from ten business days to five business days. The Ministry is prohibited from requesting additional requirements or documentation already held in its physical or electronic archives, and must update procedure information on the Citizen Portal within one year.

CONSIDERING

That the last paragraph of article 25 of the Political Constitution of the United Mexican States establishes, among other aspects, that authorities of all levels of government must implement public policies for administrative simplification and digitalization of procedures and services, good regulatory practices, development and strengthening of public technological capacities and other objectives established by the national law in this matter;

That the National Law to Eliminate Bureaucratic Procedures provides, among the obligated subjects, the dependencies of the Federal Public Administration, and that said subjects will govern their actions in accordance with the principles of legal certainty, citizen trust, proportionality, publicity, transparency, among others;

That in terms of article 24 of the National Law to Eliminate Bureaucratic Procedures, procedures and services provided for in laws, regulations, manuals, guidelines or any other provision may be simplified through general agreements published in the corresponding dissemination medium; likewise, sections II and V of the aforementioned article provide that the cited general agreements will have the object of establishing response times shorter than the maximums provided for and implementing any other action of improvement, simplification and digitalization of procedures and services;

That in accordance with what is provided for in articles 24 and 26 of the Federal Law of Para-Statutory Entities, Decentralized Organizations must register in the Public Registry of Decentralized Organizations, which may issue certifications of the registrations and records referred to in article 25 of said Law, which will have public faith;

That the representation, processing and resolution of matters within the competence of the Ministry originally corresponds to the head of the same, and that said Dependency, through the Federal Fiscal Attorney's Office, has the faculty to coordinate the activities related to the Public Registry of Decentralized Organizations, and

That, for the foregoing, with the purpose of providing certainty and legal security to the public in general and contributing to promoting regulatory improvement in the simplification of the procedures and services offered by the Ministry of Finance and Public Credit, I have deemed it appropriate to issue the following:

TRANSITORY

FIRST.

This Agreement will enter into force on the day of its publication in the Official Gazette of the Federation.

SECOND.

Procedures submitted prior to the publication of this Agreement will be resolved in accordance with the applicable regulations in force at the time of their submission.

THIRD.

The Ministry of Finance and Public Credit, in accordance with this Agreement, will not request additional requirements beyond those provided for, nor documentation that is in its physical or electronic archives.

FOURTH.

The Ministry of Finance and Public Credit will make the necessary adjustments to the Guidelines to regulate the operation of the Public Registry of Decentralized Organizations, linked to this Agreement, within a maximum period of one year from the entry into force of the same, so that, until such Guidelines are modified, the provisions of this Agreement will apply.

FIFTH.

The Ministry of Finance and Public Credit will update the information of the procedures mentioned in this Agreement on the Citizen Portal for Procedures and Services, in accordance with articles 53 and 54 of the National Law to Eliminate Bureaucratic Procedures.
