Agreement Establishing Simplification and Administrative Improvement Actions for Procedures Before Financiera para el Bienestar

Financiera para el Bienestar updates the names of four telegraphic and financial procedures and implements specific simplification measures, including the elimination of certain identification and address proof requirements for transactions under 5,000 USD. The maximum resolution time for complaints and claims is reduced from 60 to 30 natural days, and four legacy procedures are removed from the Citizen Single Portal for Procedures and Services. These changes enter into force the day after publication in the Official Gazette.

AGREEMENT establishing simplification and administrative improvement actions for procedures carried out before Financiera para el Bienestar

MTRA. MARÍA DEL ROCÍO MEJÍA FLORES, General Director of Financiera para el Bienestar, based on what is provided in articles 25, tenth paragraph of the Political Constitution of the United Mexican States; 45 and 50 of the Organic Law of the Federal Public Administration; 22 of the Federal Law of Parastatal Entities; 1, 2, 6, 7 section I, 8, 9 sections IX and XII, 10 sections II, III, V and IX, and 19 and 24 of the National Law to Eliminate Bureaucratic Procedures; 4 of the Federal Administrative Procedure Law; 4 section XIV, 11 sections II, V, and XIV of the Organic Statute of Financiera para el Bienestar,

CONSIDERING

That the last paragraph of article 25 of the Political Constitution of the United Mexican States establishes that in order to contribute to the development and well-being of people, groups, communities and social and economic sectors, authorities of all levels of government must implement public policies for administrative simplification and digitalization of procedures and services, good regulatory practices, development and strengthening of public technological capacities and the other objectives established by the national law in this matter.

That on October 21, 2022, the Decree modifying the name of the decentralized organism Telecomunicaciones de México, Telecomm, was published in the Official Gazette of the Federation, due to the fact that, to improve and extend its services to a greater number of people, mainly those residing in communities excluded by traditional banking, it is natural to expand the offer with credits, savings promotion and reinforcement of international trade (remittances), so it is beneficial, technically and economically, to take advantage of the infrastructure and coverage of Telecomm, in order to reach the target population; as a result of this expansion, the name of said organism changed, to remain as "Financiera para el Bienestar".

That Financiera para el Bienestar is a decentralized organism of the Federal Public Administration, with legal personality and its own assets, sectorized to the Ministry of Finance and Public Credit, whose object is the provision of the public service of telegraphs, national and international telegraphic transfers, financial services, radiotelegraphy, telecommunications and financing.

That article 6 of the National Law to Eliminate Bureaucratic Procedures establishes that dependencies, decentralized bodies and entities of the Federal, State, Municipal Public Administration and territorial demarcations of the Mexico City must reduce bureaucratic costs for the provision of procedures and services to a minimum, seeking that the regulations they issue for these effects generate the greatest possible benefit for people, in compliance with the principles of legal certainty, citizen trust, proportionality, publicity and transparency, among others.

That in accordance with articles 8 and 10 of the National Law to Eliminate Bureaucratic Procedures, the National Simplification and Digitalization Authority, is the Digital Transformation and Telecommunications Agency and has the attribution, among others, to make proposals for simplification and digitalization of Procedures and Services to the Obligated Subjects; as well as to coordinate and supervise their implementation.

That to facilitate access and the obtaining of procedures and services, dependencies, decentralized bodies and entities of the Federal Public Administration will not request documents that they themselves issue; they will assume the greatest regulatory burden; they will not request simple copies for the management of procedures or services; they will eliminate unnecessary requirements; they will reduce the response times of procedures or services; they will substitute permits for notices, when applicable; they will merge procedures that are related to each other and create simultaneous flows that facilitate processes for user persons.

That the objectives of the administrative simplification policy are to modernize procedures and services, which may be simplified through general agreements published in the corresponding dissemination medium, and in observance of article 24 of the National Law to Eliminate Bureaucratic Procedures, simplification may be in accordance with the enablement of electronic tools for the presentation of procedures and services, the establishment of response times shorter than the maximum provided for, extending the validity of resolutions granted by obligated subjects, eliminating requirements and bureaucratic costs of any type and Implementing any other action of improvement, simplification and digitalization of the procedures and services within their competence.

Therefore, with the aim of providing certainty and legal security to the general public and contributing to promoting regulatory improvement in the simplification of the procedures and services offered by Financiera para el Bienestar, it has been deemed appropriate to issue the following:

AGREEMENT ESTABLISHING SIMPLIFICATION AND ADMINISTRATIVE IMPROVEMENT ACTIONS FOR PROCEDURES CARRIED OUT BEFORE FINANCIERA PARA EL BIENESTAR:

ARTICLE FIRST.- National telegraphic transfer service: It shall be understood by such what is established in section XIV of article 1° of the Organic Statute of Financiera para el Bienestar. Likewise, when reference is made to the national transfer in this Agreement and in all legal acts and documents issued by FINABIEN, it shall be understood that it refers to the cited service.

TRANSITORY CLAUSES

FIRST. This Agreement will enter into force the day following its publication in the Official Gazette of the Federation.

SECOND. Procedures entered prior to the entry into force of this Agreement will be processed in accordance with the applicable regulations in force at the time of their presentation.

THIRD. In accordance with this Agreement, Financiera para el Bienestar will not request additional requirements to those provided for in this, nor documentation that is in its physical or electronic files, or additional simple copies to those established in this agreement.

FOURTH. For procedures with homoclaves FINABIEN-02-006 Issuance of national transfer and FINABIEN-02-005 Payment of national transfer, a simple copy may be requested for the operations specified in article two of this Agreement, temporarily until the technological improvements for their management are implemented.

FOURTH. Financiera para el Bienestar must make the necessary adjustments to the normative instruments linked to this Agreement within the maximum period of one hundred twenty natural days counted from the entry into force thereof.

FIFTH. Financiera para el Bienestar will update the information of the procedures and services mentioned in this Agreement on the Citizen Single Portal for Procedures and Services, in accordance with articles 53 and 54 of the National Law to Eliminate Bureaucratic Procedures.
