AGREEMENT establishing simplification and administrative improvement actions for procedures carried out before the Institute of Administration and Appraisal of National Assets

AGREEMENT ESTABLISHING SIMPLIFICATION AND ADMINISTRATIVE IMPROVEMENT ACTIONS FOR PROCEDURES CARRIED OUT
BEFORE THE INSTITUTE OF ADMINISTRATION AND APPRAISAL OF NATIONAL ASSETS.
DR. PABLO ISRAEL ESCALONA ALMERAYA, President of the Institute of Administration and Appraisal of National Assets, a Decentralized Administrative Body of the Ministry of Finance and Public Credit, based on what is provided in articles 25, paragraph tenth of the Political Constitution of the United Mexican States; 1, 2, fraction I, 17, 26, fraction VI and 31 fractions XXIX and XXX of the Organic Law of the Federal Public Administration; 1, 2, 6, 7 fraction I, 8, 9 fractions IX, XII and XIII, 10 fractions II, III, V and IX, 19, 24 and 74 of the National Law to Eliminate Bureaucratic Procedures; 4 of the Federal Administrative Procedure Law; 1, 2, fraction II, 11, 28, 29 and 101, fraction X of the General Law of National Assets; 1, 4, section G, fraction V, 48 and 49 of the Internal Regulations of the Ministry of Finance and Public Credit; as well as 1, 3, fractions XXIX and XXXI; 4 fraction I, subsection a) and 6, fractions I and XXVI, of the Regulations of the Institute of Administration and Appraisal of National Assets.
CONSIDERING
That the last paragraph of article 25 of the Political Constitution of the United Mexican States establishes that in order to contribute to the development and well-being of people, groups, communities and social and economic sectors, authorities of all levels of government must implement public policies for administrative simplification and digitalization of procedures and services, good practices regulatory, development and strengthening of public technological capacities and the other objectives established by national law in the matter.
That the National Law to Eliminate Bureaucratic Procedures establishes that dependencies, decentralized administrative bodies and entities of the Federal, State, Municipal Public Administration and territorial demarcations of Mexico City, must reduce to the minimum the bureaucratic costs for the provision of procedures and services, seeking that the regulations they issue for these effects generate the greatest possible benefit for people, in compliance with the principles of legal certainty, citizen confidence, proportionality, publicity and transparency, among others.
That in accordance with articles 8 and 10 of the National Law to Eliminate Bureaucratic Procedures, the National Authority of Simplification and Digitalization, is the Digital Transformation and Telecommunications Agency and has the attribution, among others, to carry out proposals for simplification and digitalization of Procedures and Services to the Obligated Subjects; as well as coordinate and supervise their implementation.
That to facilitate access and the obtaining of procedures and services, dependencies, decentralized administrative bodies and entities of the Federal Public Administration, will not request documents that they themselves issue; they will assume the greatest regulatory burden; they will not request simple copies for the management of procedures or services; they will eliminate unnecessary requirements; they will reduce the response times for procedures or services; they will substitute permits for notices, when appropriate; they will merge procedures that are related to each other and they will create simultaneous flows that facilitate processes for users.
That the objectives of the administrative simplification policy are to modernize procedures and services, which can be simplified through general agreements published in the corresponding dissemination medium and in compliance with article 24 of the Law National to Eliminate Bureaucratic Procedures, simplification may be in accordance with the enablement of electronic tools for the submission of procedures and services, the establishment of response times shorter than the maximum provided for, extending the validity of resolutions granted by obligated subjects, eliminating requirements and bureaucratic costs of any kind and Implement any other action of improvement, simplification and digitalization of the procedures and services under its competence.
That the Organic Law of the Federal Public Administration provides that, for effective attention in the handling of matters of the State Secretariats, these may have decentralized administrative bodies.
That on March 23, 2004, the new General Law of National Assets was issued, establishing in its transitional articles the creation of a new decentralized administrative body of the Ministry of Finance and Public Credit, in substitution of the Commission of Appraisal of National Assets, which is the Institute of Administration and Appraisal of National Assets itself, which would take charge of the attributions that the General Law of National Assets grants to said dependency in matters of administration of federal real estate and appraisal of national assets.
That the vision of the Institute is to be an effective, sustainable and cutting-edge institution; that it consolidates the best use and utilization of the heritage of Mexicans, contributing to the social and economic well-being of the country, under the principles of austerity, honesty and inclusion.
That among its objectives are to provide legal certainty to Federal and Parastatal Real Estate Heritage; the promotion of control and better real estate utilization; keeping the regulatory framework governing real estate policy up to date; the issuance of timely and transparent appraisal opinions, as well as the strengthening of institutional capacities in compliance with the policy of republican austerity.
Therefore, and with the purpose of implementing simplification actions, the following is issued:

ARTICLE TENTH. - The Single Format is established for the procedures with homoclaves: INDAABIN-00-003-A and INDAABIN-00-003-B, derived from the elimination of requirements and improvement implemented, which are mentioned in articles first and fourth of this Agreement, which is integrated as ANNEX V.
ARTICLE ELEVENTH. -
The formats contained in Annexes I to IX of this Agreement may be reproduced by any means, so that the petitioners can use them in the procedures referred to in this Agreement, provided that their content is not altered.

TRANSITIONAL
FIRST. This Agreement will enter into force twenty business days after its publication in the Official Gazette of the Federation.
SECOND. Procedures submitted prior to the publication of this Agreement will be resolved in accordance with the applicable regulations in force at the time of their presentation.
THIRD. The Institute of Administration and Appraisal of National Assets, in accordance with this agreement, will adopt the actions of the National Model to Eliminate Bureaucratic Procedures.
FOURTH. The Institute of Administration and Appraisal of National Assets will carry out the actions to carry out the adjustments necessary to the normative instruments of an administrative nature linked to this Agreement, within the maximum timeframe of one year counted from the entry into force of the same.
It will also be applicable to the adjustments that must be made in administrative procedures, registration systems, or any other mechanism that requires updating in accordance with the normative changes introduced
FIFTH. The Institute of Administration and Appraisal of National Assets will update the information of the procedures and services mentioned in this Agreement on the Single Citizen Portal for Procedures and Services, in accordance with articles 20 fraction IV, 51 and 53 of the National Law to Eliminate Bureaucratic Procedures.
