Agreement Establishing the Digital Modality for Issuing the Federal Criminal Record Certificate by the Ministry of Security and Citizen Protection through the OADPRS

AGREEMENT through which the digital modality for the issuance of the Federal Criminal Record Certificate is made known by the Ministry of Security and Citizen Protection through the Decentralized Administrative Body Prevention and Social Reintegration.

Omar Reyes Colmenares, Head of the Decentralized Administrative Body Prevention and Social Reintegration,

based on what is established in articles 27, fraction IV of the National Penal Execution Law;

1, 3, section C, fraction IV, 46 fraction XIV, 53 and 54 of the Internal Regulations of the Ministry of Security and

Citizen Protection; 8, 10, 19, fraction XIX, 20, fraction XVII, of the Regulations of the Decentralized Administrative Body

Prevention and Social Reintegration, and

CONSIDERING

That in accordance with the second paragraph of article 18 of the Political Constitution of the United

Mexican States, the Penitentiary System will be organized based on respect for human rights,

work, training for the same, education, health and sport;

That in terms of article 3, fraction I of the National Penal Execution Law, the penitentiary authority

depends on the Federal Executive Power or the federative entities in charge of operating the System

Penitentiary;

That the Decentralized Administrative Body Prevention and Social Reintegration of the Ministry of

Security and Citizen Protection, is the Institution in charge of organizing and administering the Centers

Federal Reintegration Centers, for people deprived of their liberty, processed and in execution of

sentences;

That on July 17, 2023, the

AGREEMENT through which the digital modality for the issuance of the Certificate of

Federal Criminal Records by the Ministry of Security and Citizen Protection through the Organism

Administrative Decentralized Prevention and Social Readaptation.

That as a result of the reform to the Regulations of the Decentralized Administrative Body Prevention and

Social Reintegration, published in the Official Journal of the Federation on August 2, 2024, it is necessary

adapt the regulations governing this decentralized body, so I have deemed it appropriate to issue the following

AGREEMENT THROUGH WHICH THE DIGITAL MODALITY FOR THE

ISSUANCE OF THE FEDERAL CRIMINAL RECORD CERTIFICATE BY THE

MINISTRY OF SECURITY AND CITIZEN PROTECTION THROUGH THE DECENTRALIZED ADMINISTRATIVE BODY

PREVENTION AND SOCIAL REINTEGRATION

FIRST. This Agreement aims to make known to the citizenry the digital modality

for the issuance and obtaining of the Federal Criminal Record Certificate, which may be

requested through the digital platform available at the following electronic address: https:// constancias.oadprs.gob.mx/.

SECOND. For the purposes of this Agreement, Federal Criminal Record Certificate is understood to be that document that contains the data and records of people who have been sentenced to a penalty

depriation of liberty, through resolutions or sentences, issued by judicial authorities of the

federal jurisdiction competent.

THIRD. In accordance with article 27 fraction IV, of the National Penal Execution Law, the

Certificate regarding Federal Criminal Records can only be extended in the following

situations:

a)

When requested by competent administrative and judicial authorities, for purposes of

criminal investigation, procedural or by request of a judicial authority;

b)

When it is requested because it is necessary to exercise a right or fulfill a legally

provided duty;

c)

In specific cases where the regulations establish it as a requirement to perform

a job, position or commission in public service, or for entry to institutions of

public or private security, as well as when due to the nature of the employment or for reasons of public interest

it is considered exigible;

d)

When requested by a foreign embassy or consulate in Mexico, or through a

embassy or consulate of Mexico abroad.

FOURTH. To request the Digital Certificate of Federal Criminal Records, through the

digital platform, the interested person must carry out the following steps:

You must enter the page https://constancias.oadprs.gob.mx/;

Enter CURP with 18 characters;

Validate the identification data that appears on the screen, in case of homonyms attach birth

certificate and official identification in PDF format;

Fill in the corresponding spaces for email, as well as the reasons for request of the

Digital Certificate of Federal Criminal Records;

Make online payment or through a capture line for payment at a bank counter, and

Once the payment is made, the time for issuing the certificate will depend on whether it is reflected

in the system, and if there are no homonyms, you can receive the link for downloading it

in an approximate period of 72 hours.

FIFTH. The Digital Certificate of Federal Criminal Records will not have specific validity.

SIXTH. The platform will be available 24 hours a day, 365 days a year.

SEVENTH.

The cost for the issuance of the Federal Criminal Record Certificate will be fixed

in accordance with what is established in article 5 of the Federal Rights Law and will be updated annually within

the Fiscal Miscellany of the corresponding fiscal year.

EIGHTH. In the event of attaching documents without validity, or that are different from those requested, or of omitting

the attachment of any of the latter, the procedure will be cancelled without refund of the amount paid.

NINTH. The validity of the link for downloading the certificate will be thirty calendar days.

TENTH. The link for downloading the certificate will be sent to the registered email during the procedure

only once.

TRANSITORY

FIRST.- This Agreement will enter into force on the next business day following its publication in the Official

Journal of the Federation.

SECOND.- This Agreement, leaves without effect the one issued on July 17, two thousand

twenty-three.
