AGREEMENT Modifying the General Provisions on Treasury Functions

MARÍA ELVIRA CONCHEIRO BÓRQUEZ, Treasurer of the Federation, based on articles 31, section XXXII of the Organic Law of the Federal Public Administration; 1, 2, sections I, V, VII and XII, 5, 6, 17, 18, 20, 21 and 26 of the Federal Treasury Law; 18, 19, 20, 21 and 22 of the Regulation of the Federal Treasury Law; 3 and 51 of the Federal Budget and Fiscal Responsibility Law; and 31, sections II and III of the Internal Regulation of the Ministry of Finance and Public Credit, and

WHEREAS

That on February 15 and March 30, 2023, modifications to the General Provisions on Treasury Functions regarding the Single Treasury Account System were published in the Official Gazette of the Federation, so that the administration of federal public resources is carried out in a more transparent, efficient and timely manner, and

That the Treasury of the Federation has considered it convenient to specify the validity of the bank accounts referred to in article 18, last paragraph, of the Federal Treasury Law, therefore I have seen fit to issue the following:

AGREEMENT MODIFYING THE GENERAL PROVISIONS ON TREASURY FUNCTIONS

SOLE. - Provisions 41 and 45 Quater are AMENDED, as well as Transitory Article Third, of the modifications to the General Provisions on Treasury Functions, published in the Official Gazette of the Federation on February 15 and March 30, 2023, respectively, to read as follows:

" 41. The authorization for the opening of the corresponding bank account shall be valid in the fiscal year in which it is granted, and the bank account must be closed within the first 15 business days of the following year. The foregoing, except in those cases, that due to their administrative nature or legal situation justified by the Agency or Entity, the Treasury determines a different period. "

" 45 Quater. The authorization for the opening of the corresponding bank account shall be valid in the fiscal year in which it is granted, and the bank account must be closed within the first 15 business days of the following year. The foregoing, except in those cases, that due to their administrative nature or legal situation justified by the Agency or Entity, the Treasury determines a different period. "

" Third. For the purposes of this Amending Agreement, the Agencies and Entities must cancel, no later than June 30, 2023, all bank accounts that have been authorized by the Treasury of the Federation, before February 16, 2023, except in those cases that, due to their administrative nature or legal situation justified by the Agencies or Entities, the Treasury of the Federation determines a different period.

The authorization issued by the Treasury of the Federation, regarding the bank accounts that, due to non-compliance, were not cancelled on the date referred to in the previous paragraph, shall become void as of January 1, 2024, and it shall be the responsibility of the public servants assigned to the Agencies or Entities that within the scope of their powers corresponds to their non-observance, as well as for the use, management and destination of the public resources that, where applicable, remain in said accounts, in terms of the applicable legal provisions.

The validity provided for in provisions 41 and 45 Quater of these Provisions, for the bank accounts that have been authorized and opened from February 16, 2023 and until the end of fiscal year 2023, shall be extended during fiscal year 2024, so their closure shall be carried out within the first 15 business days of fiscal year 2025.

The omission of this obligation shall be made known by the Treasury of the Federation to the internal control body or its equivalent in the Agencies and Entities, for their competence in matters of administrative responsibilities of public servants. "

TRANSITORY PROVISIONS

First. This Amending Agreement shall enter into force on the day following its publication in the Official Gazette of the Federation.

Second. The legal provisions that oppose this Agreement are repealed.
