Agreement to deincorporate the federal property "Concentrador Valle" from the public domain regime and authorize its sale via public tender

The Agreement deincorporates the federal property "Concentrador Valle," located in Benito Juárez, Mexico City, from the public domain regime and authorizes its sale through a public tender. The sale price must be paid in a single installment and cannot be lower than the appraisal issued by the Institute of Administration and Appraisal of National Assets. The Institute will conduct the necessary administrative acts, and the purchaser is responsible for all associated taxes, fees, and expenses.

AGREEMENT TO DEINCORPORATE FROM THE PUBLIC DOMAIN REGIME OF THE FEDERATION THE FEDERAL PROPERTY WITH AN AREA OF 250.00 SQUARE METERS, DESIGNATED "CONCENTRADOR VALLE", LOCATED AT AVENUE COYOACÁN EJE 3 PONIENTE NUMBER 523, COLONIA DEL VALLE CENTRO, POSTAL CODE 03100, ALCAIDÍA BENITO JUÁREZ, MEXICO CITY, WITH FEDERAL REAL ESTATE REGISTRY 9-17496-9 AND AUTHORIZE ITS SALE FOR VALUE THROUGH PUBLIC TENDER.

DR. PABLO ISRAEL ESCALONA ALMERAYA, President of the Institute of Administration and Appraisal of National Assets, Autonomous Administrative Body of the Secretariat of Treasury and Public Credit, under the provisions of articles 1, 2 fraction I, 17, 26 fraction VI and 31 fractions XXIX and XXX of the Organic Law of the Federal Public Administration; 2 fractions II, IV and VII, 3 fraction III, 4, paragraphs first and second, 6 fraction XXI, 11 fraction I, 13, 28 fraction I, 29 fractions I, II and VI, 84 fraction I, 85, 88, 95 and 101 fraction VI of the General Law of National Assets; 1, 4 section G, fraction V, 48 and 49 of the Internal Regulations of the Secretariat of Treasury and Public Credit and; 1, 3 fraction X, 4 fraction I, subsection a) and 6 fraction XXXIII of the Regulations of the Institute of Administration and Appraisal of National Assets, and

CONSIDERING

FIRST.- That among the assets subject to the public domain regime of the Federation is the federal property with an area of 250.00 square meters, designated "Concentrador Valle", located at Avenue Coyoacán Eje 3 Poniente number 523, Colonia Del Valle Centro, Postal Code 03100, Alcaldía Benito Juárez, Mexico City, with Federal Real Estate Registry 9-17496-9.

SECOND.- That the ownership of the property referred to in the preceding Consideration is accredited through public deed number 3, volume 3, dated December 8, 1981, granted before the notary of Licentiate Jorge Antonio Sánchez Cordero Dávila, Holder of Public Notary Office number 153 of the then Federal District and of the Federal Property Estate, through which, the sales contract regarding an area of 250.00 square meters was recorded, which was celebrated by the C.C. María Guerrero Allande, Martha Rojas Vande Wyngaert widow of Guerrero, Martha María Guerrero Rojas de Cuervo, Susana Margarita Guerrero Rojas de Hope, Laura Guerrero Rojas de Morales and María Isabel Guerrero Rojas de García, as sellers, and the Federal Government, through the then Secretariat of Human Settlements and Public Works as buyer, which is registered in the Public Registry of the Federal Property, under Real Folio number 13051 dated September 7, 1983 and in the Public Registry of Property and Commerce of Mexico City, under Real Folio number 163757 dated 2 June 1983.

THIRD.- That the area, measurements and boundaries of the property subject to this Agreement are recorded in topographic plan number TOP-01 of 01, prepared at scale 1:50, approved and registered on February 4 2016, under number DRPCI/09-17496-9/5629/2016/T; by the Directorate of Public Registry and Real Estate Control, attached to the General Directorate of Policy and Real Estate Management of the Institute of Administration and Appraisal of National Assets.

FOURTH.- That by office number 401.4S.15-2022/0898 dated May 11, 2022, the Subdirectorate of Catalog and Zones, attached to the National Coordination of Historical Monuments of the National Institute of Anthropology and History, informed the General Directorate of Administration of Federal Real Estate Assets that the property subject to this Agreement, "... is not a Historical Monument, does not border a Historical Monument and is not within a Zone of Historical Monuments."

FIFTH.- That by office number DPI/2064/2024 dated November 26, 2024, the Directorate of Real Estate Planning attached to the General Directorate of Policy and Real Estate Management of the Institute of Administration and Appraisal of National Assets informed that the property subject to this Agreement, "... has been published on the Institutional website, in the section of Real Estate Availability, "Portfolios of Available Federal Real Estate", in the following timeframes:

  • From June to July, and in November, all of 2022, and
  • From February to September 2024."

SIXTH.- That through Unique Land Use Zoning Certificate with folio number 36191- 151CODI24 dated December 2, 2024, the Certifier of the Directorate of Plans and Programs Registry of the Secretariat of Planning, Territorial Organization and Metropolitan Coordination of the Secretariat of Urban Development and Housing of the Government of Mexico City, determined that for the property subject to this Agreement, the Zoning: H/4/20/M and HC/4/20/Z is applicable.

SEVENTH.- That by office number 0008-C/0008 dated January 9, 2025, the Directorate of Architecture and Conservation of Artistic Immovable Heritage of the National Institute of Fine Arts and Literature (INBAL), informed the General Directorate of Administration of Federal Real Estate Assets that the property subject to this Agreement, "... is not considered an Artistic Monument nor is it included in the INBAL list of Properties with Artistic Value".

EIGHTH.- That the Real Estate Exploitation Committee of the Institute of Administration and Appraisal of National Assets, in its First Extraordinary Session 2025, held on January 20, 2025, approved by unanimity Agreement 1/2025 CAI, determining the actions for the best use and exploitation of the property subject to this Agreement, for its sale for value, in terms of article 84 fraction I of the General Law of National Assets.

NINTH.- That by office number DGPGI/087/2025 dated February 19, 2025, the General Directorate of Policy and Real Estate Management communicated to the General Directorate of Administration of Federal Real Estate Assets, both of this Institute of Administration and Appraisal of National Assets, the Opinion for Acts of Administration and/or Disposition number DAAD/2025/001, in which it considered that, since the property subject to this Agreement is not cataloged as a common use asset, in accordance with what is established by article 7 of the General Law of National Assets, the normative hypothesis provided for in article 84 of the referred Law is met, therefore the actions of administration and disposition established in the various fractions of the invoked article could be appropriate. Attending the content of the office cited in this Consideration, in the specific case, it is applicable the fraction I of article 84 of the General Law of National Assets.

TENTH.- That the General Directorate of Administration of Federal Real Estate Assets of this Institute, in accordance with what is provided by article 11, fraction V of the Regulations of this Institute, knew and reviewed from a technical-legal point of view, the deincorporation from the public domain regime of the Federation and authorization to sell the federal property designated "Concentrador Valle". The legal and technical documentation supporting the legal and administrative situation of the property, as well as of this Agreement, is in the processing file integrated by said General Directorate and was duly checked with that found in the Federal and Para-statal Real Estate Information System. Under the provisions of article 9, fraction XIV, in relation to article 11, fraction V of the Regulations of the Institute of Administration and Appraisal of National Assets, the Legal Unit issued an opinion procedent regarding this Agreement; therefore, based on the considerations referred to and being the purpose of the Federal Executive to give the federal real estate estate the optimal exploitation, I have deemed it appropriate to issue the following:

AGREEMENT

FIRST.- It is deincorporated from the public domain regime of the Federation and the sale for value through public tender is authorized, the federal property with an area of 250.00 square meters, designated "Concentrador Valle", located at Avenue Coyoacán Eje 3 Poniente number 523, Colonia Del Valle Centro, Postal Code 03100, Alcaldía Benito Juárez, Mexico City, with Federal Real Estate Registry 9-17496-9.

SECOND.- The sale price will be covered by the purchaser in a single payment and shall not be lower than that determined in the corresponding appraisal, which for such effect shall be issued by the Institute of Administration and Appraisal of National Assets, through the respective appraisal. If after the public tender the property has not been sold, the provisions of article 85 of the General Law of National Assets shall apply.

THIRD.- The Institute of Administration and Appraisal of National Assets, will act on behalf of and representation of the Federation, the corresponding acts to carry out the operation that is authorized.

FOURTH.- The taxes, fees, honorariums and expenses that arise as a result of the operation that is authorized, will be covered by the purchaser in accordance with what is established in the legal dispositions respectively.

FIFTH.- The Institute of Administration and Appraisal of National Assets within the scope of its attributes, through the General Directorate of Administration of Federal Real Estate Assets, will monitor the strict compliance with this Agreement.

This Agreement will enter into force the day after its publication in the Official Gazette of the Federation.
