AGREEMENT to disincorporate from the regime of public domain of the Federation, the federal property with an area of 1,721

At the margin, a seal with the National Coat of Arms, which reads: United Mexican States.- TREASURY.- Ministry of Finance and Public Credit.- Institute of Administration and Appraisal of National Assets.- AD-004-2024.

AGREEMENT to disincorporate from the regime of public domain of the Federation, the federal property with an area of 1,721.98 square meters, named "Desarrollo Urbano Tabasco 2000", located at Circuito Municipal number 106, Interior 1, Colonia Tabasco 2000, Villahermosa, Postal Code 86035, Municipality of Centro, State of Tabasco, with Federal Real Estate Registry number 27-4345-5 and authorizing its alienation for value through public tender.

VÍCTOR JULIÁN MARTÍNEZ BOLAÑOS, President of the Institute of Administration and Appraisal of National Assets, Decentralized Administrative Body of the Ministry of Finance and Public Credit, based on the provisions of articles 1, 2 fraction I, 17, 26 and 31 fractions XXIX and XXX, of the Organic Law of the Federal Public Administration; 2 fractions II, IV and VII, 3 fraction III, 4 paragraphs first and second, 6 fraction XXI, 11 fraction I, 28 fraction I, 29 fractions I, II and VI, 84 fractions I and VI, 85, 88, 95 and 101 fraction VI, of the General Law of National Assets; 1, 4, section G, fraction V, 48 and 49, of the Internal Regulations of the Ministry of Finance and Public Credit and; 1, 3 fraction X, 4 fraction I, subsection a) and 6 fraction XXXIII, of the Regulations of the Institute of Administration and Appraisal of National Assets; and

CONSIDERING

FIRST.- That among the assets subject to the regime of public domain of the Federation, is the federal property with an area of 1,721.98 square meters, named "Desarrollo Urbano Tabasco 2000", located at Circuito Municipal number 106, Interior 1, Colonia Tabasco 2000, Villahermosa, Postal Code 86035, Municipality of Centro, State of Tabasco, with Federal Real Estate Registry number 27- 4345-5.

SECOND.- That the ownership of the property referred to in the preceding Consideration is accredited through a Contract of free, pure and simple donation number 30 dated November 9, 1993, registered in the Federal Property Registry under Real Folio number 32802 on December 20, 1993.

THIRD.- That by office number 401.3S.10.2021/0717 dated July 6, 2021, the Subdirectorate of Registration of Immovable Archaeological Monuments, attached to the Directorate of Public Registration of Monuments and Archaeological and Historical Zones of the National Institute of Anthropology and History, informed that the property subject of this Agreement is not registered as a historical monument.

FOURTH.- That by office number 1448-C/1372 dated August 12, 2021, the Subdirectorate of Projects and Works, attached to the Directorate of Architecture and Conservation of Immovable Artistic Heritage of the General Subdirectorate of Immovable Artistic Heritage of the National Institute of Fine Arts and Literature (INBAL), informed that the property subject of this Agreement is not declared as an artistic monument, is not included in the INBAL List of Properties with Artistic Value, and does not border any construction included in the INBAL List of Properties with Artistic Value.

FIFTH.- That through publication records dated March 11, 2022 and January 26, 2024, and based on article 49 fraction II of the General Law of National Assets, as well as numeral 118 of the Agreement establishing the provisions in Matter of Material Resources and General Services, it was noted that the information regarding the property subject of this Agreement was disseminated to the Dependencies, Entities and other Public Institutions, through its publication on the website of this Institute for at least 5 natural days counted from February 28, 2022 and January 18, 2024.

SIXTH.- That the Real Estate Utilization Committee of the Institute of Administration and Appraisal of National Assets, in the Minutes of Agreements of the First Ordinary Session of the Real Estate Utilization Committee 2024, held on March 21, 2024, agreed to modify the Agreement issued in the Second Extraordinary Session, held on July 29, 2022, where it was determined through Agreement number 05/ 2022 CAI, to authorize actions for the best use and utilization of the federal property, for its onerous alienation or contribution to the assets of entities and public institutions, to remain as follows:

" AGREEMENT 05/2022 CAI.-

" The members of the Real Estate Utilization Committee in accordance with the functions provided in the Rules for its integration and operation, determine to authorize actions for the best use and utilization of the federal property named " Desarrollo Urbano Tabasco 2000 " , R.F.I. 27- 4345-5, located at Calle Circuito Municipal No. 106 interior 1, Colonia Tabasco 2000, Locality Villahermosa, Municipality Centro, C.P. 86035, State of Tabasco, for its alienation for value, as well as for its onerous alienation or contribution to the assets of entities and public institutions, in accordance with article 84, fractions I and VI of the General Law of National Assets, according to what was requested and justified by the DGAPIF. As a result of the above, the Executive Secretary is instructed to return the legal administrative file, in order for the Members of the CAI to implement the actions and procedures corresponding to such effect. "

Emphasis added.

SEVENTH.- That through offices numbers DGPGI/484/2022 and DGPGI/294/2024, dated September 14, 2022 and April 11, 2024, the General Directorate of Real Estate Policy and Management communicated to the General Directorate of Administration of Federal Real Estate Assets of this Institute, the Opinion for Acts of Administration and/or Disposition number DAAD/2022/006, in which it considered that the property object of this Agreement, not being classified as a common use asset, in accordance with what is established by article 7 of the General Law of National Assets, the normative hypothesis provided for in article 84 of the cited Law is met, therefore the acts of administration and disposition established in the various fractions of the invoked article could be appropriate.

Attending to the content of the cited office in this consideration, in the specific case, fractions I and VI of article 84 of the General Law of National Assets are applicable.

EIGHTH.- That the area, measurements and boundaries of the property subject of this Agreement are recorded in topographic plan number SC-598-2023, prepared at a scale of 1:150, approved and registered by the Directorate of Public Registration and Real Estate Control attached to the General Directorate of Real Estate Policy and Management of the Institute of Administration and Appraisal of National Assets, on November 8, 2023, under number DRPCI/7221/27-4345-5/2023/T and certified on November 9, 2023.

NINTH.- That through Alignment Certificate and Assignment of Official Number identified with folio number 58292 dated January 8, 2024, the Directorate of Works, Territorial Planning and Municipal Services of the Constitutional City Council of Centro, State of Tabasco, stated that the official nomenclature of the property subject of this Agreement is Circuito Municipal number 106, Interior 1, Colonia Tabasco 2000, Villahermosa, Postal Code 86035, Centro, Tabasco.

TENTH.- That through land use feasibility with folio number 58754 dated January 25, 2024, the Directorate of Works, Territorial Planning and Municipal Services of the Constitutional City Council of Centro, State of Tabasco, informed that the property subject of this Agreement is located in a mixed residential use zone medium density (HM/3/30/M).

ELEVENTH.- That the legal documentation was duly integrated and checked with that which appears in the Federal and Parastatal Real Estate Information System.

TWELFTH.- That the General Directorate of Administration of Federal Real Estate Assets of this Institute, in accordance with what is provided by article 11, fraction V, of its Regulations, knew and reviewed from a technical-legal point of view, the disincorporation from the regime of public domain of the Federation and the authorization to alienate the federal property named "Desarrollo Urbano Tabasco 2000".

The legal and technical documentation supporting the legal and administrative situation of the property, as well as of this Agreement, is in the processing file integrated by said General Directorate.

Based on article 9 fraction XIV of the Regulations of the Institute of Administration and Appraisal of National Assets, the Legal Unit issued an opinion regarding the appropriateness of this Agreement; therefore, based on the considerations referred to and being the purpose of the Federal Executive to give the optimal utilization to the federal real estate assets, I have deemed it appropriate to issue the following:

A G R E E M E N T

FIRST.- It is disincorporated from the regime of public domain of the Federation and the alienation for value through public tender is authorized, the federal property with an area of 1,721.98 square meters, named "Desarrollo Urbano Tabasco 2000" , located at Circuito Municipal number 106, Interior 1, Colonia Tabasco 2000, Locality Villahermosa, Postal Code 86035, Municipality of Centro, State of Tabasco, with Federal Real Estate Registry number 27-4345-5.

SECOND.- The sale price will be covered by the acquirer in a single installment and shall not be lower than that determined for such effect by the Institute of Administration and Appraisal of National Assets, through the respective appraisal. If the public tender is held and the property has not been alienated, the provisions of article 85 of the General Law of National Assets shall apply.

THIRD.- The Institute of Administration and Appraisal of National Assets, on behalf and representation of the Federation, will carry out the corresponding acts to carry out the authorized operation.

FOURTH.- The taxes, rights, fees and expenses that arise as a result of the authorized operation will be covered by the acquirer in accordance with what is established in the respective legal provisions.

FIFTH.- The Institute of Administration and Appraisal of National Assets within the scope of its attributes, through the General Directorate of Administration of Federal Real Estate Assets, will supervise the strict compliance with this Agreement.

This Agreement will enter into force the day following its publication in the Official Gazette of the Federation.
