This agreement resumes Phase B (Registration and Inscription) of the call for customs agent patents published on June 22, 2023, eliminating the previous maximum limit of 100 applications per day and extending the registration window to 24 hours. It validates the filings of applicants who registered correctly under the original terms, listed by folio, name, and RFC, while granting an additional 48 uninterrupted hours for new or affected applicants to register using a reinforced application system with captcha and advanced electronic signature verification. Investigations into prior irregularities continue but do not halt the process, maintaining continuity for Mexican natural persons by birth participating in the selection process.

AGREEMENT TO RESUME THE CALL FOR APPLICATIONS TO OBTAIN A CUSTOMS AGENT PATENT PUBLISHED IN THE OFFICIAL GAZETTE OF THE FEDERATION ON JUNE 22, 2023.
The National Customs Agency of Mexico, decentralized administrative body of the Secretariat of Finance and Public Credit; based on articles 1, 14, 16, 25 and 90 of the Political Constitution of the United Mexican States; 1, 2, Section I, 17, 18, 26 and 31, Sections XI and XII of the Organic Law of the Federal Public Administration; 4, Section G, Section VI, 48 and 49 of the Internal Regulations of the Secretariat of Finance and Public Credit; 1, first paragraph, 2, Sections II and XXI, 6, 144, Sections XIX, XXI and XXXIX and 159 of the Customs Law; 216 and 233 of the Regulations of the Customs Law; 1, 2, Section IV, 3, Section XIII, 4, first paragraph, Section A, 11, first paragraph, as well as Sections XIII, XVII, subsection a) and XX, 25 Sections XXIII and XXIV of the Internal Regulations of the National Customs Agency of Mexico, in relation to provision 13, Section XLV of the cited Internal Regulations; as well as in terms of articles 1, 2, 3, 5, 6 and 11, Section VI, 28 and 30 of the Federal Law of Administrative Procedure of supplementary application, in accordance with articles 1 of the Customs Law, 12 and 13 of the Federal Fiscal Code, the following is issued:
AGREEMENT
In order to safeguard the legal interest of the applicants to obtain the customs agent patent referred to in the CALL published in the Official Gazette of the Federation on June 22, 2023, by this National Customs Agency of Mexico, PHASE B. Registration and inscription of applicant persons of CHAPTER II PHASES, of the aforementioned CALL IS RESUMED, with the modality established in this AGREEMENT and with the purpose of facilitating the registration and inscription process: the maximum number of applications per day is eliminated and the hours are extended to 24 hours; the foregoing since there are persons who for work reasons or their daily activities, would be unable to make their registration in the schedule from 9:00 to 19:00 hours, as indicated in the CALL that is resumed.
Validity was also given to the registrations of those applicant persons who submitted their application in time and form according to the aforementioned CALL, as well as the recognition of the human right of persons whose applications were cancelled for not having carried them out within the schedule indicated therein to carry out their registration process again in accordance with the guidelines of this AGREEMENT; in the same way, 2 (two) additional business days are granted to these persons and to any other interested in participating, so that they can register and enroll in terms of the CALL during 48 hours uninterruptedly, by virtue of the fact that the oversight bodies of the National Customs Agency of Mexico have indicated that their investigations are underway and that to be able to determine a possible hacking, it is necessary to have more elements that allow concluding this circumstance; however, from the analysis carried out they have noticed that the detected irregularities were possibly due to a saturation of applications in the application that caused it to collapse and provoke the irregularities indicated in the " AGREEMENT relative to the General Call to obtain customs agent patent published on June 22, 2023 " , published in the Official Gazette of the Federation on past July 3, 2023, which rendered without effect PHASE B. Registration and inscription of applicant persons of CHAPTER II PHASES, in the same way, the oversight bodies have also indicated that their investigations are in the process of integrating information and documentation in order to have sufficient evidentiary elements to determine what is conducive; notwithstanding the foregoing, said bodies state that the determinations that may result do not affect the development and continuity of the CALL. Therefore, this is resumed with the implementation of a more robust application that includes higher levels of security, such as the integration of a captcha that avoids the use of robots in the registration of applications, the use of the e.firma authorized by the Tax Administration Service for the unequivocal identification of applicant persons, and carrying out stress tests that ensure the capacity and optimal performance of the application, among others. Likewise, the development of the " Registration Guide for Applicants for the Obtention of Customs Agent Patent " was incorporated, with the purpose of facilitating the registration and inscription of applicant persons.
The foregoing, in strict adherence to applicable regulations and to the principles of equality, legality, transparency, objectivity, impartiality and efficiency that must prevail in public service, considering the following:
BACKGROUND
First. That on June 22, 2023, the CALL to obtain customs agent patent was published in the Official Gazette of the Federation.
Second. That in CHAPTER II, PHASES, B. Registration and inscription of applicant persons, the following is established:
" The registration and inscription will begin on the same day of the publication of this CALL in the Official Gazette of the Federation and will last inexorably five business days (including the day of its publication) without any extension.
For the registration and inscription process, applicant persons must have their valid advanced electronic signature certificate, issued by the Tax Administration Service and register online at the link (URL) https://intra.anam.gob.mx/convocatoria_aa The applicant must register their personal data and upload in PDF format, with a maximum weight of 5 MB per file, the documents that prove compliance with the requirements established in this CALL, with the exception of the proof of payment of Rights for concept of exam for applicant to customs agent, which will be presented once their application has been accepted and notified.
For the optimal functioning of the registration system it is recommended to use the following browsers:
Internet Explorer 10 or superior.
Firefox 30.0 or superior.
Safari 6.1 or superior.
Chrome 27.0 or superior.
For the purposes of the previous numeral, a maximum of 100 applications per day will only be received. If on one day there were less than 100 registered applications, the missing ones of that day will accumulate to the next day, and so on.
During the period of registration of applications, the system will be available, from 9:00 hrs. of each day and will close at the moment that the maximum number of applications allowed per day have been registered or at 19:00 hrs. The time zone used is that of Mexico City.
Once the documentation is reviewed and validated, the applicants will receive a communication via electronic means, indicating that their application was admissible and they will be called to take the knowledge exam of this CALL or a requirement to remedy some requirement not covered, for which there will be a period of five business days to do so, from the next business day after the notification takes effect, in terms of article 135 of the Federal Fiscal Code(9). Not remedying the requirement in the established period, will result in the non-admissibility of the application and, in case of having presented original documents, to the return of the documentation exhibited by the applicant. The foregoing, will be made known to applicant persons through official letter issued by the General Legal Directorate of Customs of the National Customs Agency of Mexico, notified via electronic means... "
Third. That the last paragraph of the CALL indicates that this will be developed in strict adherence to applicable regulations and to the principles of legality, transparency, objectivity, impartiality and efficiency.
Fourth. That in accordance with CHAPTER II, PHASES, B. Registration and inscription of applicant persons, numeral 3, the period of registration of applications occurred on the days 22, 23, 26, 27 and 28 of June 2023, during which records were drawn up for irregularities noticed in the inscription process.
Fifth. That on July 3, 2023, the " AGREEMENT relative to the General Call to obtain customs agent patent published on June 22, 2023 " was published in the Official Gazette of the Federation, by means of which, PHASE B. Registration and inscription of applicant persons of CHAPTER II PHASES, of the cited CALL, IS RENDERED WITHOUT EFFECT, continuing with the process until such time as the oversight bodies of the National Customs Agency of Mexico, analyze, resolve and where applicable sanction the detected irregularities.
Sixth. That by means of official letter number 2504 dated November 6, 2023 the General Directorate of Evaluation of the National Customs Agency of Mexico, indicated that the investigations concerning the anomalies derived from failures in the registration system for obtaining the customs agent patent are in the phase of integrating information and documentation that allow having sufficient evidentiary elements to determine what is conducive in accordance with their powers provided in Sections V and X of article 33 of the Internal Regulations of the National Customs Agency of Mexico and that the determinations that may result from the analysis process do not affect the development and continuity of the CALL for obtaining the customs agent patent.
CONSIDERATIONS IN THE FOLLOW-UP OF THE PROCESS
First. That attentive to the backgrounds described above and facts that are detailed below, Mexican natural persons by birth, who participated in the selection process to obtain a customs agent patent, in terms of the CALL published in the Official Gazette of the Federation on June 22, 2023 and obtained their registration on the platform and that in accordance with what was published in the Official Gazette of the Federation on July 3, 2023, regarding the " AGREEMENT relative to the General Call to obtain customs agent patent published on June 22, 2023 " , which rendered without effect PHASE B. Registration and inscription of applicant persons of CHAPTER II PHASES, may continue with the other phases of the procedure.
Second. That derived from the observed irregularities, the folios of the persons listed below are recognized as valid, since they registered in time and form in accordance with what was established in the CALL that was issued for such effect, who may continue with the process and should not register again as a consequence of this AGREEMENT, since the registration they already have is definitive and valid to continue with the different stages of the procedure of the CALL, if they so wish:

Cabe aclarar que aún cuando las personas antes mencionadas ya han sido notificadas por la Dirección
General Jurídica de Aduanas, vía electrónica de la cancelación de su solicitud, también se les hace de su
conocimiento la misma por medio del presente ACUERDO.
No obstante lo anterior, en aras de garantizar sus derechos humanos, al reanudarse el CAPÍTULO II,
FASES, B. Registro e inscripción de las personas aspirantes, de la CONVOCATORIA para obtener la
patente de agente aduanal, se les invita a las personas antes mencionadas, así como a cualquier otra que
tenga interés en participar en la CONVOCATORIA que se reanuda, a llevar a cabo el proceso de registro e
inscripción, conforme a la modalidad del presente ACUERDO.
ACUERDO
En este orden - se reitera-, que a fin de salvaguardar el interés jurídico de las personas que participaron en
la CONVOCATORIA publicada en el Diario Oficial de la Federación el 22 de junio de 2023, en el proceso de
selección para aspirar a la obtención de una patente de agente aduanal, así como cualquier otra que tenga
interés en participar, se REANUDA la FASE B. Registro e inscripción de las personas aspirantes del
CAPÍTULO II FASES , de la CONVOCATORIA publicada en el Diario Oficial de la Federación el 22 de junio de
2023, continuándose con el proceso hasta su conclusión conforme a lo antes planteado, y otorgando un
tiempo adicional de registro para aquellas personas cuyas solicitudes quedaron canceladas por haberse
registrado fuera del horario establecido en la citada CONVOCATORIA, así como para cualquier otra persona
que tenga interés en participar en dicha CONVOCATORIA.
Ahora bien, las personas interesadas en participar en la reanudación de la CONVOCATORIA publicada el
22 de junio de 2023, se sujetarán a la modalidad siguiente:
1.- Para el proceso de registro e inscripción, las personas aspirantes deberán contar con su
certificado de firma electrónica avanzada vigente, emitida por el Servicio de Administración Tributaria
y registrarse en línea en la liga (URL) https://reinicioconvocatoria2023.anam.gob.mx
El aspirante deberá registrar sus datos personales y subir en formato PDF, con un peso máximo de
5
MB por cada archivo, los documentos que comprueben el cumplimiento de los requisitos establecidos
en la presente CONVOCATORIA, con excepción del comprobante del pago de Derechos por
concepto de examen para aspirante a agente aduanal, el cual se presentará una vez que su solicitud
haya sido aceptada y notificada.
Para el óptimo funcionamiento del sistema de registro, se recomiendan utilizar los siguientes
navegadores:
Internet Explorer 10 o superior.
Firefox 30.0 o superior.
Safari 6.1 o superior.
Chrome 27.0 o superior.
2.- Para facilitar el proceso de registro e inscripción, las personas aspirantes podrán consultar,
descargar o visualizar la " Guía de Registro de Aspirantes para la Obtención de Patente de Agente
Aduanal " en la página de la Agencia Nacional de Aduanas de México https://anam.gob.mx/ , antes de
ingresar.
3.- El registro e inscripción de las personas aspirantes comenzará al primer minuto del día
22 de
noviembre de 2023
y concluirá a las 23:59 horas del día 23 de noviembre del año en curso . Lo
anterior en adición al periodo establecido en la CONVOCATORIA publicada en el mismo Órgano
Oficial de Difusión, el 22 de junio de 2023; por tanto, este proceso de inscripción durará
inexcusablemente 2 (dos) días hábiles (22 y 23 de noviembre de 2023), sin prórroga alguna.
4.- Durante el periodo del registro de solicitudes, el sistema estará disponibles durante las 24 horas
del día. El huso horario utilizado es el de la Ciudad de México.
5.- Una vez revisada la documentación, los solicitantes recibirán un comunicado vía electrónica,
indicando que su solicitud fue aceptada y se les convocará a sustentar el examen de conocimientos
de la presente CONVOCATORIA, si así lo desea, previo pago de los derechos correspondientes en
el formato establecido para tal efecto denominado " Formulario múltiple de pago de comercio exterior "
o un requerimiento para subsanar algún requisito no cubierto, para la cual se tendrá un plazo de
cinco días hábiles para hacerlo, a partir del día hábil siguiente a que surta efectos la notificación, en
los términos del artículo 135 del Código Fiscal de la Federación. El no subsanar el requerimiento en
el plazo establecido, tendrá como resultado la no procedencia de la solicitud y, en caso de haber
presentado documentos originales, a la devolución de la documentación exhibida por el aspirante. Lo
anterior, se hará de conocimiento a las personas aspirantes a través de oficio emitido por la Dirección
General Jurídica de Aduanas de la Agencia Nacional de Aduanas de México, notificado vía
electrónica.
6.- Si alguna persona aspirante no reúne algún requisito y por cargas de trabajo la Agencia Nacional
de Aduanas de México (ANAM) no hiciere el requerimiento correspondiente, queda a salvo la
facultad de la ANAM de requerir a la persona aspirante los requisitos omitidos, en cualquier fase de
la CONVOCATORIA, y si ésta no cumpliera con los mismos dentro del término legal, se le cancelará
su solicitud.
7.-El registro e inscripción de las personas aspirantes a obtener patente de agente aduanal así como
la entrega de documentación, invariablemente deberá hacerse a través de la URL señalada en el
presente ACUERDO.
8.- Los aspirantes deberán cumplir, además de lo señalado en el presente ACUERDO, con todos y
cada uno de los lineamientos y requisitos que se establecen en la CONVOCATORIA para obtener
patente de agente aduanal, publicada en el Diario Oficial de la Federación el 22 de junio de 2023.
9.- Para aquellas personas aspirantes a obtener una patente de agente aduanal que en un juicio de
amparo se les haya concedido la suspensión provisional o definitiva, y que a la fecha esté pendiente
de resolución, durante el periodo comprendido entre el 22 de junio de 2023 y la fecha de publicación
del presente ACUERDO, en cumplimiento de dichas suspensiones, a través del presente ACUERDO
se habilitan los medios electrónicos a través de la URL https://reinicioconvocatoria2023.anam.gob.mx
con el propósito de que los quejosos estén en posibilidad de registrarse e inscribirse y presenten su
documentación para fungir como aspirante para obtener la patente de agente aduanal, por lo que se
les invita a realizar el trámite de registro e inscripción para obtener la patente de agente aduanal
conforme a la CONVOCATORIA publicada en el Diario Oficial de la Federación el 22 de junio de
2023 y al presente ACUERDO, debiendo cumplir estrictamente con las BASES, FASES y OTRAS
PREVISIONES indicadas en los CAPÍTULOS I, II y III de dicha CONVOCATORIA, así como en el
artículo 159 de la Ley Aduanera y demás requisitos.
Por otro lado, para aquellos aspirantes a obtener una patente de agente aduanal que en un juicio de
amparo se les haya otorgado la protección de la justicia federal durante el periodo comprendido entre
el 22 de junio de 2023 y la fecha de publicación del presente ACUERDO, para que se les emita una
convocatoria o se les reconozca su registro, con fundamento en el artículo 73 de la Ley de Amparo,
atendiendo al principio de relatividad de las sentencias de amparo y en cumplimiento de la ejecutoria
que se haya dictado en dichos juicios de amparo, se considerará que la CONVOCATORIA para
to obtain the customs agent patent published in the Official Gazette of the Federation on June 22, 2023, as well as this AGREEMENT that resumes it, are also directed in favor of the complainants individually, regardless of whether a call is issued to them individually if the workloads of the National Customs Agency of Mexico so permit, reason for which their registration and inscription to participate in the subsequent phases and stages of the CALL FOR APPLICATIONS to obtain the customs agent patent published in the Official Gazette of the Federation on June 22, 2023 is recognized, they must strictly comply with the BASES, PHASES and OTHER PROVISIONS, indicated in CHAPTERS I, II and III of said CALL FOR APPLICATIONS, as well as the requirements provided in article 159 of the Customs Law and other requirements; who may continue with the process and shall not have to register again as a consequence of this AGREEMENT, since the registration recognized to them is definitive and valid to continue with the different stages of the procedure of the mentioned CALL FOR APPLICATIONS, if they so wish.
For those aspiring persons who have submitted documentation through the Office of Correspondence of the National Customs Agency of Mexico, by certified mail through the Mexican Postal Service or email of the National Customs Agency of Mexico, and who by the date of entry into force of this agreement have not filed an amparo trial or any means of defense, they are informed that their application is inadmissible since they do not meet what is indicated in the BASES, PHASES and OTHER PROVISIONS of the CALL FOR APPLICATIONS published in the Official Gazette of the Federation on June 22, 2023, and if they so wish, they are invited to register and enroll in the process to obtain customs agent patent in accordance with the mentioned CALL FOR APPLICATIONS and this AGREEMENT.
10.- For the purpose of providing clarity and certainty in the resumption of the CALL FOR APPLICATIONS, CHAPTER I BASE SECOND REQUIREMENTS, CHAPTER II PHASES C, D and E and CHAPTER III OTHER PROVISIONS of this are transcribed.
" CHAPTER I BASES
SECOND. - REQUIREMENTS:
Aspiring persons must submit their application during the terms established in this CALL FOR APPLICATIONS, at the link (URL) https://intra.anam.gob.mx/convocatoria_aa , in which they state:

Full name.
·
RFC and CURP.
·
Curriculum vitae with photograph.
·
Choose 3 customs offices of assignment where they wish to operate, so that the customs authority designates based on the needs of the service to which customs office they are assigned.
·
Domicile to hear and receive notifications.
·
Email and alternate email to receive notifications.
·
Fixed or mobile telephone and alternate fixed or mobile telephone.
Likewise, based on article 159 of the Customs Law(4) and 51, section I of the Federal Duties Law in force(5), in relation to procedure form 38/LA of Annex 2 of the General Rules on Foreign Trade for 2023(6), they must upload in the referred link (URL), in .pdf files, the documentation that is required below, in order to carry out the verification of compliance with requirements, in the following terms:
I.
Be Mexican by birth in full exercise of their rights.
Aspiring persons must present a birth certificate issued by the corresponding Civil Registry with an issuance date not exceeding one year.
In the event that the birth certificate has been issued by a Mexican Embassy or Consulate abroad, aspiring persons must present a certified copy of it; and in the case of having been issued in a language other than Spanish, they must be accompanied by the corresponding translation and apostille.
The foregoing, without prejudice to the information that the National Customs Agency of Mexico may request from the competent authorities in order to corroborate the veracity of what is stated by the aspiring persons.
II.
Not have been convicted by final and binding sentence for an intentional crime and in the case of having been a customs agent or customs attorney, their patent has not been canceled or extinguished.
Aspiring persons must present a letter under protest of telling the truth duly signed with the date on the day of its presentation, addressed to the General Legal Directorate of Customs of the National Customs Agency of Mexico, through which they state: not having been convicted by final and binding sentence for an intentional crime, nor having been a customs agent or customs attorney, or in case of having been one, state that their patent has not been canceled or extinguished.
The foregoing, without prejudice to the information that the National Customs Agency of Mexico may request from the competent authorities in order to corroborate the veracity of what is stated by the aspiring persons.
III.
Not be a public servant, except in the case of popularly elected positions, nor military on active duty.
Aspiring persons must present a letter under protest of telling the truth duly signed with the date on the day of its presentation, addressed to the General Legal Directorate of Customs of the National Customs Agency of Mexico, through which they state: not being a public servant, except in the case of popularly elected positions, nor military on active duty.
The foregoing, without prejudice to the information that the National Customs Agency of Mexico may request from the competent authorities in order to corroborate the veracity of what is stated by the aspiring persons.
IV.
Not have kinship by consanguinity in a straight line without limitation of degree and collateral up to the fourth degree, nor by affinity, with the administrator of the customs office of assignment of the patent.
Aspiring persons must present a letter under protest of telling the truth duly signed with the date on the day of its presentation, addressed to the General Legal Directorate of Customs of the National Customs Agency of Mexico. through which they state not having kinship by consanguinity in a straight line without limitation of degree and collateral up to the fourth degree, nor by affinity, with the holder of the customs office of assignment of the patent.
The foregoing, without prejudice to the information that the National Customs Agency of Mexico may request from the competent authorities in order to corroborate the veracity of what is stated by the aspiring persons.
V.
Have a professional title or its equivalent in the terms of the law of the matter.
Aspiring persons must present a Professional Title of bachelor's level, duly registered before the General Directorate of Professions of the Secretariat of Public Education.
In the event of having a Professional Title issued abroad, aspiring persons must present a certified copy of the official letter of revalidation of Professional Title issued by the General Directorate of Accreditation, Incorporation and Revalidation of the Secretariat of Public Education.
Under no circumstances will a professional title issued abroad be accepted, without its corresponding revalidation of studies in Mexico, so certificates or requests for revalidation procedures will not be valid.
The foregoing, without prejudice to the information that the National Customs Agency of Mexico may request from the competent authorities, in order to corroborate the veracity of what is stated by the aspiring persons. For this effect, based on article 233 of the Regulations of the Customs Law(7), it shall be understood that the requirement of having a professional title or its equivalent is not satisfied, when it has been presented for the obtaining of the patent and has resulted false or non-existent.
VI.
Have experience in customs matters, greater than five years.
Aspiring persons must present a document with an updated date, with which they reliably accredit having experience in customs matters, greater than 5 years.
Said certificate must be issued by some company, registered in the register of importers and exporters of the Tax Administration Service or customs agent or customs agency, addressed to the General Legal Directorate of Customs of the National Customs Agency of Mexico, that continuously carries out customs and foreign trade operations, with which the aspiring persons accredit having occupied positions related to said activities for more than 5 years.
The referred certificate must be signed by the customs agent, manager, director or person with an analogous position, in which it details the functions performed by the aspiring persons, the time they worked or have been working, and the location data of whoever signs it, such as telephone number and email.
It may also be presented a certificate of inscription to the register of importers and exporters of the Tax Administration Service, addressed to the General Legal Directorate of Customs of the National Customs Agency of Mexico, stating that it is an importer/exporter of goods and services. The registration to the register of importers and exporters must be valid and have an antiquity greater than five years.
Likewise, they may present as certificate the master's or doctorate titles in customs and foreign trade matters with an issuance date greater than five years, or well, those that accredit them as professors in said matters at a minimum bachelor's level for more than 5 years.
The foregoing, without prejudice to the information that the National Customs Agency of Mexico may request from the competent authorities, companies and corresponding agencies, in order to corroborate the veracity of what is stated by the aspiring persons.
VII.
Be registered in the federal taxpayer registry, and demonstrate being current in the compliance of their tax obligations.
Aspiring persons must present the opinion on compliance with tax obligations in a positive sense issued by the Tax Administration Service, on the day of its presentation, in terms of article 32-D, penultimate paragraph of the Federal Fiscal Code(8).
The foregoing, without prejudice to the information that the National Customs Agency of Mexico may request from the competent authorities in order to corroborate the veracity of what is stated by the aspiring persons.
VIII.
Pass the knowledge exam that the customs authority practices and a psychotechnical exam.
Aspiring persons must present and result approved with a minimum grade of 85 points out of 100, in the knowledge exam, in order to be in possibility of sustaining the psychotechnical exam.
Inexcusably, aspiring persons must accredit the totality of the evaluations that the preceding paragraph refers, in order to proceed with the continuity of the process.
Under no circumstances will the knowledge and psychotechnical exams that have been practiced by the customs authority to the aspiring persons prior to the publication of this CALL FOR APPLICATIONS be taken into account, either under the procedure for obtaining customs agent patent by diverse CALL FOR APPLICATIONS, or by procedure for obtaining customs agent patent by substitution. "
" CHAPTER II PHASES
C.
Application of the knowledge exam.
The application of the knowledge exam will be practiced for a single occasion and will be in charge of the General Legal Directorate of Customs of the National Customs Agency of Mexico, at the headquarters and schedule that the customs authority determines. The foregoing, will be made known to the aspiring persons via electronic means.
Under no circumstances may the knowledge exam be sustained at headquarters, date or time different from the established one, nor will attendance justifications of any kind be accepted.
To have the right to sustain the exam, aspiring persons must attend punctually at the headquarters, date and schedule established, presenting the proof of payment of Duties for concept of exam for aspiring customs agent (said payment will not be returned under any circumstance, even if the application results inadmissible), and accredit their identity with one of the following documents: valid voter credential; professional credential with photograph or valid passport.
The knowledge exam, will be composed of five modules, which will value the following:
a)
General knowledge of Customs Law and Foreign Trade (Political Constitution of the United Mexican States; International Treaties in customs matters and foreign trade (Free Trade Agreement between the United States of America, the United Mexican States and Canada, published in the Official Gazette of the Federation on June 29, 2020; Framework Agreement of the Pacific Alliance, published in the Official Gazette of the Federation on July 17, 2015; Additional Protocol of the Framework Agreement of the Pacific Alliance, published in the Official Gazette of the Federation on January 15, 2016; Decision 2/ 2000 of the Joint Council of the Interim Agreement on Trade and Matters Related to Trade between the United Mexican States and the European Community, published in the Official Gazette of the Federation on June 26, 2000); Customs Law and its Regulation, Foreign Trade Law and its Regulation; Law on General Import and Export Taxes; General Rules on Foreign Trade for 2023 and their procedure forms).
b)
General and Complementary Rules of the Law on General Import and Export Taxes.
c)
Tariff Classification.
d)
Analysis of customs entry and its annexes.
e)
Practical case of Foreign Trade operations.
Each of the five modules will have a value of 20 points giving a total of 100 points. The final grade of the knowledge exam, will be calculated evaluating individually the five modules indicated, and adding the results obtained in each one, so that, to obtain an approving result, aspiring persons must obtain a minimum grade of 85 out of 100 points.
In case of not approving the knowledge exam with the requested score, or of not having sustained it, this will be considered not approved, proceeding to conclude the application and, in case of having presented original documents, to the return of the documentation exhibited by the aspirant. The foregoing, will be made known to the aspiring persons through an official letter issued by the General Legal Directorate of Customs of the National Customs Agency of Mexico, notified via electronic means.
D.
Application of psychotechnical exam.
In case that aspiring persons obtain approved result in the knowledge exam, it will be notified via electronic means, day and time for the application of the psychotechnical exam (medical-toxicological, polygraph, socioeconomic environment and psychological evaluations), which will be in charge of the General Directorate of Evaluation of the National Customs Agency of Mexico.
To have the right to sustain the evaluation, aspiring persons must attend punctually at the headquarters, date and schedule established and accredit their identity with one of the following documents: valid voter credential; professional credential with photograph or valid passport.
Under no circumstances may the psychotechnical exam be sustained at headquarters, date or time different from the established one by the General Directorate of Evaluation of the National Customs Agency of Mexico, nor will attendance justifications of any kind be accepted.
It is responsibility of the aspiring persons, to present themselves on the date and time indicated to sustain the psychotechnical exam.
The requirements of the psychotechnical exam will be made known to the aspirants via electronic means 30 calendar days before the application of the same; and, at the moment of presenting the aspirant, they will be made known the procedures and indications of the evaluation.
Likewise, the results of these evaluations will be made known to the aspirants, via electronic means, 10 business days after their application.
In case of not approving the psychotechnical exam, or of not having sustained it, this will be considered not approved, proceeding to conclude the application and, in case of having presented original documents, to the return of the documentation exhibited by the aspirant. The foregoing, will be made known to the aspiring persons through an official letter issued by the General Legal Directorate of Customs of the National Customs Agency of Mexico, notified via electronic means.
E.
Granting of customs agent patent.
In the event that aspiring persons fully comply with the BASES, PHASES and OTHER PROVISIONS indicated in CHAPTERS I, II and III of this CALL FOR APPLICATIONS, as well as with the requirements provided in article 159 of the Customs Law in force, proceeding will be made to the granting of customs agent patent, prior payment of Duties, for concept of issuance of customs agent patent, in terms of article 51 section II of the Federal Duties Law in force(10), in relation to procedure form 40/LA of Annex 2 of the General Rules on Foreign Trade for 2023(11).
It is to be noted that, the customs agent patent is personal and non-transferable, and will be granted to the interested party, in a term not greater than four months counted from the notification of the official letter that will be issued by the General Legal Directorate of Customs of the National Customs Agency of Mexico, through which, aspiring persons will be informed having strictly complied with the BASES, PHASES and OTHER PROVISIONS indicated in CHAPTERS I, II, III of this CALL FOR APPLICATIONS, as well as with the requirements provided in article 159 of the Customs Law in force.
Once notified the official letter of obtaining customs agent patent, the aspiring persons to whom the patent has been granted, will have 20 business days counted from when the notification of the cited official letter takes effect, to request its publication in the Official Gazette of the Federation, under the warning that, if not formalized thus, what agreed will be without effect and the customs agent patent will be deregistered.
On the following business day of the publication of the granting of customs agent patent in the Official Gazette of the Federation, it will be activated. "
" CHAPTER III
OTHER PROVISIONS
For those aspirants to obtain a customs agent patent that through an amparo trial have been granted the protection of federal justice based on article 73 of the Amparo Law (principle of relativity of amparo sentences)(12), and in compliance of the executory, a CALL FOR APPLICATIONS directed to the complainant has been issued in their favor and that has been published in the Official Gazette of the Federation, they must subject themselves to the BASES, PHASES, STAGES and procedure of the same, without being able to participate and enroll in this CALL FOR APPLICATIONS.
For those applicants of the amparo trial that seek to be issued a CALL FOR APPLICATIONS and can participate in the BASES, PHASES and OTHER PROVISIONS indicated in CHAPTERS I, II, III of this CALL FOR APPLICATIONS, to obtain a customs agent patent, and that still at the moment this CALL FOR APPLICATIONS is published have not obtained favorable final and binding sentence, they must subject themselves to this CALL FOR APPLICATIONS , since that is the pretension of the complainants.
It is specified that, the results obtained in the evaluations of the knowledge and psychotechnical exams, are definitive, unappealable and confidential, so the aspiring persons accept the conditions established for their application from the moment of their participation in this CALL FOR APPLICATIONS.
For the realization of the knowledge and psychotechnical exams, aspiring persons may not introduce any documentation, nor use cellular telephones, computers, tablets, or any other electronic device.
The non-compliance of the BASES, PHASES and OTHER PROVISIONS indicated in CHAPTERS I, II and III of this CALL FOR APPLICATIONS, as well as of any irregularity that the aspiring persons present during the development of the same, will bring as consequence the cancellation of their application. The foregoing, will be made known to the aspiring persons through an official letter issued by the General Legal Directorate of Customs of the National Customs Agency of Mexico, notified via electronic means.
It is responsibility of the aspiring persons to provide with veracity, authenticity and precision their personal data, as well as the requirements requested in this CALL FOR APPLICATIONS. If the existence or authenticity of the documentation presented by the aspiring persons is not accredited at the moment of the documentary review, or if not exhibited for its comparison on the date, time and place indicated, it will be notified via electronic means to the aspiring persons by official letter issued by the General Legal Directorate of Customs of the National Customs Agency of Mexico, the reason for inadmissibility, leaving the application without effect and proceeding, in case of having presented original documents, to the return of the same.
This CALL FOR APPLICATIONS will be developed in strict adherence to applicable regulations and to the principles of legality, transparency, objectivity, impartiality and efficiency.
