The National Insurance and Sureties Commission modifies Annex 14.2.1-y of the Sole Insurance and Surety Circular to update the technical notes for determining the constitutive amount of pensions derived from retirement, old-age, and disability insurance. The amendment incorporates a reference to the average guaranteed pension corresponding to a minimum wage and sixty years of age from Article 170 of the Social Security Law for cases involving a change from Programmed Retirement to Life Annuity. Authorized insurance institutions must apply these adjusted calculation procedures to ensure technical support for pension premiums.

The National Insurance and Sureties Commission, based on the provisions of articles 26, second paragraph, 200, 201, 202, 366, section II, 367, sections I and II, 369, section I, 372, sections V, VI, XLI and XLII, 373 and 381 of the Law of Insurance and Surety Companies, and:
CONSIDERING
That in the exercise of supervisory powers, inconsistencies were identified in the determination of constitutive amounts for cases of old-age disability that fall under the scenario of changing from Programmed Retirement to Life Annuity, since the current technical note made known through Amending Circular 11/23 published in the Official Journal of the Federation on December 27, 2023, does not contemplate that in such cases the reference for the purpose of calculating the sufficiency of the individual account must be the average of the guaranteed pensions corresponding to a minimum wage and sixty years of age obtained from the table of Article 170 of the Social Security Law (LSS), as established in the last paragraph of Article 157 of that same Law.
That adjustments were made to the technical note for the calculation of the constitutive amount of life annuities for retirement, old-age and disability insurance corresponding to the pension regime of the Mexican Social Security Institute (IMSS), in order to incorporate the reference to the average of the guaranteed pensions corresponding to a minimum wage and sixty years of age from the table of said Article 170 of the LSS, in the calculation of constitutive amounts for cases of old-age disability that fall under the scenario of changing from Programmed Retirement to Life Annuity.
That the Law of Systems for Retirement Savings in its Article 81 establishes that the procedures related to the calculation of the constitutive amount for the contracting of life annuities and survival insurance will be in charge of the Committee referred to in said provision.
That said Committee, in its Session of October 21, 2025, approved the adjustments to the calculation procedures for the constitutive amounts for pensions derived from retirement, old-age and disability insurance, in order to specify the reference for the calculation of the constitutive amount of old-age disability pensions that fall under the scenario of changing from Programmed Retirement to Life Annuity.
That in view of the foregoing, attending to what is provided in articles 26, second paragraph, 200, 201 and 202 of the Law of Insurance and Surety Companies, so that institutions authorized to practice Pension Insurance derived from Social Security Laws have the technical support for the premium of these insurance, it is considered necessary to modify Annex 14.2.1-y of the Sole Insurance and Surety Circular, in order to modify the Technical Note for the determination of the Constitutive Amount for pensions derived from retirement, old-age and disability insurance and the Technical Note for the determination of the constitutive amount for pensions derived from Article 172-A of the LSS applicable to policies issued under the coverage of the "Decree by which various provisions of the Social Security Law and the Law of Systems for Retirement Savings are reformed, added and repealed", published in the Official Journal of the Federation on December 16, 2020, by the one approved on October 21, 2025 by the Committee referred to in Article 81 of the Law of Systems for Retirement Savings.
That in light of the considerations exposed, this Commission, with the agreement of its Board of Directors, issues the following modification to the Sole Insurance and Surety Circular in the following terms:
