The National Insurance and Sureties Commission eliminates the CNSF-18-001-A and CNSF-18-001-B procedures and the associated obligations to report unauthorized access incidents under Provision 4.10.18 and Annex 4.10.18 of the Single Insurance and Surety Circular. Instead, insurance institutions and mutual societies are required to conduct immediate investigations into any modification, extraction, loss, or deletion of sensitive user information, or any suspected unauthorized access. If such incidents occur, institutions must notify affected users within three business days to warn them of risks and specify necessary protective measures. This modification takes effect on the business day following its publication in the Official Gazette.

AMENDING CIRCULAR 11/18 OF THE SINGLE INSURANCE AND SURETY CIRCULAR
(Provision 4.10.18; Annex 4.10.18.)
The National Insurance and Sureties Commission, based on the provisions of Articles 366, fraction II, 372, fractions VI and XLII, 373 and 381 of the Law of Insurance and Surety Institutions, and
CONSIDERING
That on March 8, 2017, the "Agreement establishing the guidelines that must be observed by the dependencies and decentralized organisms of the Federal Public Administration, regarding the issuance of general administrative acts to which Article 69-H of the Federal Administrative Procedure Law applies," was published in the Official Gazette of the Federation, through which, in terms of its Fifth Article, the Dependencies of the Federal Public Administration that issue new general administrative acts must expressly indicate in the corresponding draft the two regulatory obligations or the two acts that will be repealed or abrogated and that refer to the same regulated matter or economic sector.
That on February 23, 2018, Amending Circular 1/18 of the Single Insurance and Surety Circular was published in the Official Gazette of the Federation, by virtue of which, in accordance with what is established in its Second Transitory Provision and with the purpose of complying with the Fifth Article of the aforementioned Agreement, the National Insurance and Sureties Commission acquired the commitment to simplify the CNSF-18-001-A procedure "Report incidents of unauthorized access to Sensitive User Information on electronic media. Modality A: Report of Incidents on unauthorized access to Sensitive User Information" and the obligation to send what is stated in fraction I of Provision 4.10.18 of Chapter 4.10 "On the use of electronic media for the contracting of insurance and surety operations" and Annex 4.10.18 "Format for the report of information relative to cases where the sensitive information of the user is extracted, lost or the institutions and mutual societies suppose or suspect of some incident involving unauthorized access to said information in electronic operations" of the Single Insurance and Surety Circular; as well as the CNSF-18-001-B procedure "Report incidents of unauthorized access to Sensitive User Information on electronic media. Modality B: Report of results of the investigation carried out on incidents related to unauthorized access to Sensitive User Information on electronic media, to determine if the information has been or may be misused" and the obligation to send what is stated in fraction II of Provision 4.10.18 of Chapter 4.10 "On the use of electronic media for the contracting of insurance and surety operations" of the Single Insurance and Surety Circular, within a period of six months counted from the publication of said Amending Circular in the Official Gazette of the Federation.
That in order to comply with the Second of the Transitory Provisions of the aforementioned Amending Circular 1/18, the National Insurance and Sureties Commission eliminates the aforementioned CNSF-18-001-A and CNSF-18-001-B procedures, suppressing the obligation to send what is stated in fractions I and II of Provision 4.10.18, as well as Annex 4.10.18, of the Single Insurance and Surety Circular, carrying out the necessary adjustments to the aforementioned Provision.
For the above stated, this Commission issues the following modification to the Single Insurance and Surety Circular in the following terms:
AMENDING CIRCULAR 11/18 OF THE SINGLE INSURANCE AND SURETY CIRCULAR
(Provision 4.10.18; Annex 4.10.18.)
FIRST.- Provision 4.10.18. of the Single Insurance and Surety Circular is modified, to read as follows:
4.10.18.
In the event that Sensitive User Information is modified, extracted, lost, deleted or the Institutions and Mutual Societies suppose or suspect of some incident involving unauthorized access to said information, they must carry out an immediate investigation to determine if the information has been or may be misused and in this case they must notify this situation, within the following 3 business days, to their Affected Users, in order to warn them of the risks derived from the misuse of the information that has been extracted, lost, modified, deleted or compromised, informing them of the measures they must take.
SECOND.- Annex 4.10.18. of the Single Insurance and Surety Circular is eliminated.
THIRD.- The "LIST OF ANNEXES OF THE SINGLE INSURANCE AND SURETY CIRCULAR" is modified, to eliminate from it the reference to Annex 4.10.18 "Format for the report of information relative to cases where the Sensitive Information of the User is extracted, lost or the Institutions and Mutual Societies suppose or suspect of some incident involving unauthorized access to said information in Electronic Operations".
TRANSITORY
SINGLE.- This Amending Circular will enter into force on the business day following its publication in the Official Gazette of the Federation.
The foregoing is made known to you, based on Articles 366, fraction II, 372, fractions VI and XLII, 373 and 381 of the Law of Insurance and Surety Institutions.
