Amending Circular 12/17 of the Single Insurance and Surety Circular

The National Insurance and Surety Commission declares September 19, 20, and 21, 2017, as non-working days for all legal effects due to the earthquake that occurred on September 19, 2017. This designation applies to Institutions and Mutual Societies, as well as other persons subject to the Commission's supervision, regarding proceedings, actions, or deadlines of procedures processed before the Commission. The amendment adds Chapter 13.4 and Annex 13.4.1 to the Single Insurance and Surety Circular to formalize these contingency-related non-working days. The circular entered into force on the day of its publication in the Official Gazette of the Federation.

Amending Circular 12/17 of the Single Insurance and Surety Circular

AMENDING CIRCULAR 12/17 OF THE SINGLE INSURANCE AND SURETY CIRCULAR

(Title 13; Chapter 13.4 and Annex 13.4.1.)

The National Insurance and Surety Commission, based on the provisions of Articles 366, fraction II, 372, fractions VI and XLII, 373 and 381 of the Law of Insurance and Surety Companies, and

CONSIDERING

That due to the earthquake that occurred on September 19, 2017, and in accordance with what is established in Article 48 of the Internal Regulations of the National Insurance and Surety Commission, the days on which the work of said Commission is suspended, or when its offices remain closed, will be considered non-working days for all legal effects, except in the case of scheduling days for inspection visits, in terms of the Law of Insurance and Surety Companies and other applicable legal provisions.

Therefore, the National Insurance and Surety Commission has resolved to modify the Single Insurance and Surety Circular in the following terms:

AMENDING CIRCULAR 12/17 OF THE SINGLE INSURANCE AND SURETY CIRCULAR

(Title 13; Chapter 13.4 and Annex 13.4.1.)

FIRST.- The "Content" of the Single Insurance and Surety Circular is modified in order to change the name of Title 13 "ON THE INFORMATION REGARDING OPENING, CHANGE OF LOCATION AND CLOSURE OF OFFICES" and to add the reference to Chapter 13.4 which is added to said Single Circular with the name "On non-working days due to contingency situations" to read as follows:

"13. ON THE INFORMATION REGARDING OPENING, CHANGE OF LOCATION AND CLOSURE OF OFFICES OF INSTITUTIONS AND MUTUAL SOCIETIES, AS WELL AS THE CLOSURE OF OFFICES OF THE COMMISSION"

"13.1 to 13.3 ..."

"13.4 On non-working days due to contingency situations"

SECOND.- Chapter 13.4 named "ON NON-WORKING DAYS DUE TO CONTINGENCY SITUATIONS" is added to Title 13 named "ON THE INFORMATION REGARDING OPENING, CHANGE OF LOCATION AND CLOSURE OF OFFICES OF INSTITUTIONS AND MUTUAL SOCIETIES, AS WELL AS THE CLOSURE OF OFFICES OF THE COMMISSION" of the Single Insurance and Surety Circular, to read as follows:

CHAPTER 13.4.

ON NON-WORKING DAYS DUE TO CONTINGENCY SITUATIONS

For the purposes of Article 48 of the Internal Regulations of the National Insurance and Surety Commission:

13.4.1.

In order to avoid affecting Institutions and Mutual Societies, and other persons subject to the supervision of the Commission, for the purposes of proceedings, actions or deadlines of procedures that are being or should be processed before it, and in accordance with the respective legal provisions, the days indicated in Annex 13.4.1 are considered non-working days.

THIRD.- Annex 13.4.1 is added to the Single Insurance and Surety Circular.

FOURTH.- The "LIST OF ANNEXES" of the Single Insurance and Surety Circular is modified to refer to Annex 13.4.1 named "On non-working days due to contingency situations".

TRANSITORY

SINGLE.- This Amending Circular shall enter into force on the day of its publication in the Official Gazette of the Federation.

The foregoing is made known to you, based on Articles 366, fraction II, 372, fractions VI and XLII, 373 and 381 of the Law of Insurance and Surety Companies.
