Amending Circular 17/21 of the Single Circular on Insurance and Sureties

Amending Circular 17/21 of the Single Circular on Insurance and Sureties

AMENDING CIRCULAR 17/21 OF THE SINGLE CIRCULAR ON INSURANCE AND SURETIES

(Provision 13.2.1. and Annex 13.2.1.)

The National Commission of Insurance and Sureties, based on articles 366, fraction II, 367, fraction II, 372, fractions VI, XIII and XLII, 373 and 381 of the Law of Insurance and Surety Institutions, and

CONSIDERING

That in accordance with what is established in articles 195 and 344 of the Law of Insurance and Surety Institutions, Institutions, as well as Mutual Insurance Societies, may only close their doors and suspend their operations on the days authorized for that purpose by the National Commission of Insurance and Sureties, through publication in the Official Gazette of the Federation, considering such days as non-working days for the purposes of the operations that said institutions and societies are authorized to carry out in accordance with their respective authorizations.

That by Presidential Decree published in the Official Gazette of the Federation on October 6, 1993, which was reformed by Presidential Decree published in the same official media on January 27, 2006, the Official Calendar was established, which includes the dates of national commemoration which, due to their significance and importance, are mandatory days off for the workers of the dependencies and entities of the Federal Public Administration.

That in accordance with what is established in article 48 of the Internal Regulations of the National Commission of Insurance and Sureties, the days on which work is suspended in the Commission, or when its offices remain closed, after notice given by it, will be considered non-working days for all legal purposes.

For the foregoing, the National Commission of Insurance and Sureties has resolved to modify the Single Circular on Insurance and Sureties, to read as follows:

AMENDING CIRCULAR 17/21 OF THE SINGLE CIRCULAR ON INSURANCE AND SURETIES

(Provision 13.2.1. and Annex 13.2.1.)

FIRST.- Provision 13.2.1. of the Single Circular on Insurance and Sureties is modified, to read as follows:

13.2.1.

Institutions and Mutual Societies may close their doors and suspend their operations, with the exception of claims handling, on Saturdays and Sundays, as well as those indicated in Annex 13.2.1.

SECOND.- Annex 13.2.1. of the Single Circular on Insurance and Sureties is modified.

TRANSITIONAL

SOLE.- This Amending Circular shall enter into force the day following its publication in the Official Gazette of the Federation.

This is made known to you, based on articles 366, fraction II, 367, fraction II, 372, fractions VI, XIII and XLII, 373 and 381 of the Law of Insurance and Surety Institutions.
