ASFI Circular Letter DNP CC-1614 2025 of May 30, 2025

Financial Intermediation Entities and Financial Leasing Companies must analyze and attend to requests for refinancing or restructuring of credit operations from borrowers affected by economic deterioration. These requests must be evaluated individually under Supreme Decree No. 5241 and Article 26, Section 10 of the Regulation for the Evaluation and Qualification of Credit Portfolios, allowing for grace periods, extensions, and other favorable mechanisms without automatically reclassifying the debtor to a higher risk category. The entities are required to complete the attention and analysis of such requests within thirty calendar days, ensuring equitable treatment, non-discrimination, and clear information regarding the conditions of the solutions offered.

REF: PROCEDURE NO. T-2009367568 REFINANCING AND/OR RESTRUCTURING OF CREDIT OPERATIONS

Gentlemen:

Within the framework of the powers granted to this Financial System Supervisory Authority (ASFI) by Financial Services Law No. 393, and with the purpose of providing financial relief to borrowers whose activities are being affected by factors inherent to the economic situation, resulting in a consequent deterioration of their payment capacity, it is instructed that Financial Intermediation Entities and Financial Leasing Companies attend to and analyze requests for refinancing and/or restructuring from said borrowers.

To this effect, the attention and analysis of said requests must be carried out within the framework of what is provided for in Supreme Decree No. 5241 of October 2, 2024, and in Article 26, Section 10 of the Regulation for the Evaluation and Qualification of Credit Portfolios, inserted in Chapter IV, Title II, Book 3 of the Compilation of Norms for Financial Services, evaluating borrowers individually, based on a particular valuation of each case, considering their current situation and the future prospects of their activities.

In this sense, the aforementioned refinancing and/or restructuring requests may include grace periods and/or extensions, during which time the debtor is not required to make payments on principal or interest, as well as other favorable mechanisms necessary to facilitate conditions, improve access to solutions adjusted to the characteristics of the

credit and to the particular situation of each borrower, taking into account, furthermore, that restructuring under these terms does not imply the automatic change of the cited debtor's classification to a higher risk category.

Likewise, the attention to the aforementioned requests must not exceed thirty (30) calendar days, providing equitable treatment, without discrimination, in conditions of quality, amount, timeliness, and availability adequate to the economic interests of the debtors, providing reliable, broad, complete, clear, understandable, timely, and accessible information regarding the characteristics and conditions of the refinancing and/or restructuring, offering good service and dignified treatment, acting at all times with due diligence.

The General Management of the aforementioned entities is responsible for enforcing this instruction, on which ASFI will carry out the respective control in its supervisory tasks.
