The Prudential Control and Resolution Authority (ACPR) mandates the precise composition and electronic submission format for the prior notification dossier required when mutual insurance group companies (SGAM), mutual group unions (UMG), or social protection insurance group companies (SGAPS) seek affiliation, withdrawal, or exclusion. Amended through October 2024, this Instruction supersedes the 2011 directive and operationalizes requirements under the French Monetary and Financial, Insurance, Mutual, and Social Security Codes. It establishes the definitive procedural framework, directing all filings to the ACPR portal and specifying that the dossier must strictly contain the elements outlined in its annex.

Instruction No. 2015-I-17 of June 30, 2015 on the composition of the prior notification file for affiliation, withdrawal, or exclusion of a mutual insurance group company (SGAM), a mutual group union (UMG), or a social protection insurance group company (SGAPS), as amended by Instruction No. 2018-I-15 of July 11, 2018, Instruction No. 2019-I-11 of April 18, 2019, and Instruction No. 2024-I-11 of October 21, 2024 The Prudential Control and Resolution Authority, Having regard to the Monetary and Financial Code, Having regard to the Insurance Code, particularly Articles L. 322-1-3, L. 322-1-4, and R. 322-161 thereof; Having regard to the Mutual Code, particularly Articles L. 111-4-2 and R. 115-2 thereof; Having regard to the Social Security Code, particularly Articles L. 931-2-2 and R. 931-1-16 thereof; Having regard to Ordinance No. 2015-378 of April 2, 2015; Having regard to Decree No. 2015-513 of May 7, 2015; Having regard to the opinion of the Prudential Affairs Consultative Committee dated May 28, 2015, DECIDES Article 1 The prior notification file for affiliation, withdrawal, or exclusion provided for in Article R. 322-161 of the Insurance Code for mutual insurance group companies, Article R. 115-2 of the Mutual Code for mutual group unions, and Article R. 931-1-16 of the Social Security Code for social protection insurance group companies shall comprise the elements defined in the annex to this Instruction. Article 2 This file must be submitted in electronic format to the Prudential Control and Resolution Authority by uploading it to the following address: : https://acpr-portail.banque-france.fr Article 3 Instruction 2011-I-16 is hereby repealed.
