Performance of Certain Functions by the National Futures Association With Respect to the Receipt and Processing of Exchange Disciplinary and Access Denial Action Information

The Commodity Futures Trading Commission (CFTC) issued a notice and order updating a 1999 delegation to authorize the National Futures Association (NFA) to receive and process all exchange disciplinary and access denial action notices. The order mandates that designated contract markets and swap execution facilities file these notices directly with the NFA through its BASIC system instead of the Commission, while requiring the NFA to maintain the records as the official custodian and provide the CFTC with full system access and standardized reporting capabilities. This delegation streamlines regulatory oversight by centralizing disciplinary data management with the NFA, ensuring efficient fitness determinations for registrants, and takes effect on March 13, 2018.
