Registration Process - Sindh ★ Acknowledgement Registration of all births, deaths, marriages, and divorces is mandatory. This registration must be accurate and correct. The legal framework governing births, deaths, marriages, and divorces is established by the law.
The responsibility lies with the parents, guardians, or the person present at the time of the event, and the Sub-Divisional Magistrate, Tehsildar, or Registrar.
Under Section 139, Schedule VIII (Part I) of the Birth, Death and Marriage Registration Act, 2013, the "Birth, Death and Marriage (Registration) Rules, 2017" have been framed. These rules specify the forms to be used for the registration of births, marriages, and divorces, and the responsibilities of the Registrar.
The process is simple, and registration is mandatory. Why is registration necessary? ● To establish legal identity. ● To facilitate access to social services and government benefits. ● To update the National Database and Registration Authority (NADRA) card, passport, and other documents. ● To obtain a birth certificate and death certificate. ● To ensure the proper maintenance of vital statistics.
★ Definitions ● Birth: The complete expulsion or extraction from its mother of a product of conception, irrespective of the duration of the pregnancy, which, after such separation, breathes or shows any other evidence of life, such as beating of the heart, pulsation of the umbilical cord, or definite movement of voluntary muscles, whether or not the umbilical cord has been cut or the placenta is attached. ● Registrar: The person appointed by the Government to perform the duties of a Registrar. ● Sub-Divisional Magistrate: The Sub-Divisional Magistrate of the Sub-Division, who is the administrative head of the Sub-Division. ● Form: The forms prescribed under these Rules (Form A to L). ● Death Certificate: The certificate issued by the Registrar under the relevant law (Form G) under the Births, Deaths and Marriages Registration Ordinance, 1961.

Time Limits for Registration: ● Normal Registration: Within 30 days. ● Late Registration: Between 30 days and 1 year. ● Very Late Registration: More than 1 year to 30 years.
★ Late Registration of Birth ● Within 1 year to 30 years: Form "A", the application along with the medical certificate (if not previously submitted) must be submitted; the medical certificate must be submitted within 7 days of the application. ● More than 30 years: If the application is made after 30 years, the Registrar may refuse registration.

★ Registration of Birth of a Child Born to a Foreigner ● Registration: The birth of a child born to a foreigner must be registered within 90 days of the birth in the Register of Foreigners. ● Late Registration: If the birth is not registered within 90 days, it may be registered later. ● Application: The application must be submitted to the Registrar along with the NICOP (for foreigners) or POC (Proof of Citizenship) for non-foreigners.
★ Registration of Marriage ● Responsibility: The husband and wife are responsible. ● Time Limit: The marriage must be registered within 30 days of the marriage. ● Application Form: Form "B" must be filled and submitted to the Registrar of the Sub-Division/Tehsil where the marriage took place. ● Verification: The Registrar will verify the details in the Marriage Register against the Nikah Nama (Marriage Certificate). ● Registration and Certificate: If the Registrar registers the marriage in Form "B-1", the marriage certificate (Form "D") will be issued.
★ Late Registration of Marriage If the marriage is not registered within 30 days, the Registrar may refuse registration.

The Registrar will register the divorce in Form "H-1" and issue the divorce certificate (Form "I"). ● Death Certificate: The death certificate is issued under the Births, Deaths and Marriages Registration Ordinance, 1961 (Form "G"); the death certificate must be submitted to the Registrar within 7 days along with the application. ● Time Limit: Form "H" must be submitted; the Registrar will verify the details and issue the certificate; the application must be submitted to the Government within 30 days.
Legal Framework for Divorce: ● The Birth, Death and Marriage Registration Act, 2013, applies to both men and women in Sindh. ● The Muslim Family Laws Ordinance, 1961, applies.
★ Registration of Death ● Responsibility: The head of the household, relative, or person present is responsible. ● Time Limit: The death must be registered within 30 days of the death. ● Application Form: Form "L"; the Registrar will register the death in Form "J-1"; the form "J-2" (for cremation/burial) must be filled; and the death certificate (Form "K") will be issued. ● Relevant Law: The Births, Deaths and Marriages Registration Ordinance, 1961, applies, and the registration of the death of a foreigner must be reported to the relevant consulate within 90 days of the death of the foreigner.

★ Late Registration of Death of a Foreigner ● Normal Registration: Under the Birth, Death and Marriage Registration Act, 2016 (effective 2018), the registration of the death of a foreigner must be reported to the relevant consulate within 45 days; the death of a foreigner must be registered within 30 days, and the death certificate must be issued within 30 days. ● Cremation/Burial: Under the Births, Deaths and Marriages Registration Ordinance, 1961, the cremation/burial of a foreigner must be reported to the relevant consulate within 24 hours. ● Relevant Law: Under the Birth, Death and Marriage Registration Act, 2016, the cremation/burial of a foreigner must be reported to the relevant consulate within 24 hours; the death of a foreigner must be registered within 30 days, and the death certificate must be issued within 30 days. ● Record: The record must be maintained.
★ Registration of Stillbirth/Miscarriage ● Stillbirth/Miscarriage: The application for the certificate of stillbirth/miscarriage must be submitted to the Registrar within 15 days of the birth of the child. ● Certificate: The certificate of stillbirth/miscarriage must be issued within 3 days of the application. ● Application: The application must be submitted to the Registrar within 30 days of the event. ● Fee: The fee for the certificate of stillbirth/miscarriage must be paid as prescribed.

★ Birth/Death Report ● Report: The report of birth/death must be submitted to the Registrar in Form "E" along with the certificate. ● Certificate: The certificate of birth/death must be issued by the Registrar.
