Board Resolution No. 083/2025: Approval of the Regulation for the Physical Import and Export of Foreign Currency by Regulated Financial Entities

The Board of Directors of the Central Bank of Bolivia approves a regulation requiring regulated financial entities and money transfer companies to obtain prior authorization for the physical import and export of foreign currency. Entities must submit a sworn declaration form to the Bank's International Operations Management at least four business days before the operation and present the approved form to the National Customs Agency at designated international airports. Following the transaction, entities must report the operation to the Central Bank, the Financial System Supervisory Authority, and the Financial Investigations Unit within two business days.

SUBJECT: INTERNATIONAL OPERATIONS MANAGEMENT – APPROVAL OF THE REGULATION FOR THE PHYSICAL IMPORT AND EXPORT OF FOREIGN CURRENCY TO AND FROM THE NATIONAL TERRITORY BY REGULATED FINANCIAL ENTITIES.

The report BCB-GOI-SRES-INF-2025-4 of June 26, 2025, issued by the International Operations Management (GOI).

The report BCB-GAL-SANO-DLBCI-INF-2025-203 of June 27, 2025, issued by the Legal Affairs Management (GAL).

CONSIDERING:

That Article 327 of the Political Constitution of the State establishes that the BCB is a public law institution, with legal personality, its function being to maintain the

internal purchasing power stability of the currency to contribute to economic and social development.

That Article 1 of Law No. 1670 provides that the BCB is the sole monetary and exchange authority of the country, with administrative, technical, and financial competence and specialized normative powers of general application.

That Articles 44 and the subsections a) and o) of Article 54 of Law No. 1670 establish that the highest authority of the BCB is its Board of Directors, which is responsible for defining its policies, specialized norms of general application, and internal rules; as well as establishing administrative, operational, and financial strategies of the BCB, with one of its attributes being to issue norms and adopt general decisions that may be necessary for the BCB to fulfill the functions, competencies, and powers assigned to it by the aforementioned Law, and to approve, modify, and interpret the Statute and Regulations of the BCB, by two-thirds of the votes of all its members, without the need for any additional administrative act.

That Article 3 of Law No. 1990 establishes that the National Customs Agency is the institution responsible for monitoring and supervising the passage of goods through the country's borders, ports, and airports, intervening in international merchandise traffic for the purpose of collecting taxes levied on them and generating statistics on that movement, without prejudice to other attributes or functions assigned to it by laws.

That Paragraph III of Article 2 of Supreme Decree No. 5404 modifies Article 4 of Supreme Decree No. 29681, establishing that financial intermediation entities and/or money transfer and remittance companies with a License to Operate granted by the ASFI, must carry out physical import and export operations of foreign currency to/from the national territory, in accordance with regulations established by the Central Bank of Bolivia – BCB.

That the Sole Transitional Provision of Supreme Decree No. 5404 establishes that the Financial Investigations Unit - UIF, the National Customs Agency, and the Central Bank of Bolivia – BCB, within a period of up to thirty (30) business days from the publication of the aforementioned Decree, will issue the corresponding regulation for its implementation.

That item 1) of Article 5 and items 1) and 30) of Article 10 of the Issuer Entity Statute determine that the BCB has normative competence to issue specialized norms in the fields assigned to it by the Law, and the Board of Directors has, among others, the attribute to approve general decisions and issue norms that may be necessary for the BCB to fulfill the functions, competencies, and powers assigned to it by the Law, and to approve, modify, and interpret the Statute and Regulations of the BCB, by two-thirds of the votes of all its members, without the need for an additional administrative act.

That Paragraph I of Article 24 of the aforementioned Statute provides that Resolutions and decisions of the Board of Directors are adopted by a simple majority of votes of its members present in a meeting, except in cases where Law No. 1670 or the BCB Statute require qualified majorities.

That Article 26 of the BCB Statute stipulates that the Board of Directors pronounces itself on matters within its competence through Resolutions. It may also do so through decisions that will be expressly recorded in the Minutes. Likewise, every draft Board Resolution must be motivated and justified by a technical report from the Management or Managements to whom the subject matter of the Resolution corresponds, and by a report from the Legal Affairs Management. These reports must be sent to the Board of Directors by the General Management with its recommendation.

That the report BCB-GOI-SRES-INF-2025-4 from the GOI concludes that the proposal for the "Regulation for the Physical Import and Export of Foreign Currency to and from the National Territory by Regulated Financial Entities" is technically viable, as it allows regulating the operational procedures for physical import and export, regarding the registration, control, and monitoring of cross-border transport of foreign currency; in this sense, it recommends approval by the Board of Directors.

That the report BCB-GAL-SANO-DLBCI-INF-2025-203 from the GAL concludes that, in accordance with report BCB-GOI-SRES-INF-2025-4, the proposal for the "Regulation for the Physical Import and Export of Foreign Currency to and from the National Territory by Regulated Financial Entities" does not contravene any regulatory provision; therefore, they have

the due technical and legal sufficiency, consequently recommending approval by the BCB Board of Directors.

THEREFORE, THE BOARD OF DIRECTORS OF THE CENTRAL BANK OF BOLIVIA RESOLVES:

Article 1.- Approve the Regulation for the Physical Import and Export of Foreign Currency to and from the National Territory by Regulated Financial Entities, in its two (2) Chapters and six (6) Articles, which form an integral part of this Resolution as an Annex.

Article 2.- This Resolution shall enter into force upon its publication.

Article 3.- The Presidency and the General Management are charged with the execution and compliance of this Resolution.

ANNEX

REGULATION FOR THE PHYSICAL IMPORT AND EXPORT OF FOREIGN CURRENCY TO AND FROM THE NATIONAL TERRITORY BY REGULATED FINANCIAL ENTITIES

CHAPTER I

GENERAL ASPECTS

Article 1. (Object) The purpose of this Regulation is to regulate the Physical Import and Export Operations of Foreign Currency to and from the National Territory by Regulated Financial Entities.

Article 2. (Scope of Application) This Regulation shall be applied to Regulated Financial Entities, understood as Financial Intermediation Entities and Money Transfer and Remittance Companies with a License to Operate granted by the Financial System Supervisory Authority.

Article 3. (Acronyms) The acronyms applicable to this Regulation are as follows:

a) AN: National Customs Agency. b) ASFI: Financial System Supervisory Authority. c) BCB: Central Bank of Bolivia. d) EIF: Financial Intermediation Entities. e) GOI: International Operations Management. f) UIF: Financial Investigations Unit.

CHAPTER II

PHYSICAL IMPORT AND EXPORT OF FOREIGN CURRENCY TO AND FROM THE NATIONAL TERRITORY

Article 4. (Completion of the Form)

I. Regulated Financial Entities, through their legal representative, for each physical import or export operation of Foreign Currency to or from the national territory, must complete the "Sworn Declaration Form for Physical Import and Export of Foreign Currency for Regulated Financial Entities", which is Annex I to this regulation and is available on the BCB website.

II. Said form must be submitted in two (2) copies, at least four (4) business days in advance of the operation, via a formal note addressed to the GOI of the BCB in accordance with Annex II.

III. The GOI, within the framework of its functions, will verify the completion of the form indicated in paragraph I and grant approval for the operation on the same form, which will be returned to the requesting Entity, in two physical copies, within a maximum period of two (2) business days following the receipt of the form.

Article 5. (Presentation of the Form)

I. Regulated Financial Entities must present the form with the BCB's approval to the AN at the international airports of "El Alto" in the Department of La Paz, "Jorge Wilstermann" in the Department of Cochabamba, and "Viru Viru" in the Department of Santa Cruz, at the time of the physical import or export of foreign currency to or from the national territory.

II. The AN will verify the form presented by the Regulated Financial Entity and proceed to verify the quantity of packages and/or seals for the physical import or export of foreign currency to or from the national territory; in case of inconsistencies during the verification, the AN will not authorize the import or export of the foreign currency and will proceed with the corresponding actions in accordance with current regulations.

Article 6. (Responsibility)

I. The "Sworn Declaration Form for Physical Import or Export of Foreign Currency for Regulated Financial Entities", being a sworn declaration, is a document of exclusive responsibility for the requesting Entity, so its completion must reflect the truthfulness of the information provided.

II. Regulated Financial Entities, in their capacity as Obligated Subjects before the UIF, are responsible for applying Due Diligence measures for the Prevention, Detection, Control, and Reporting of Money Laundering, Terrorism Financing, and Financing of Proliferation of Weapons of Mass Destruction, in accordance with regulations issued by the UIF.

III. The origin and destination of the foreign currency in the physical import or export operation from the national territory must originate from or be destined to one or more regulated and supervised financial entities in the country of origin or destination.

IV. Once the physical import or export operation of foreign currency to and from the national territory has been carried out, the Regulated Financial Entity must send a copy of the form with the AN's stamp to the BCB, the ASFI, and the UIF via a formal note, within a period not exceeding two (2) business days following the operation.

V. For control, supervision, and statistical purposes on a monthly basis, the BCB will report the issued forms to the ASFI and the UIF.
